The draft new Code of Administrative Offenses (CAO) and the Code of Procedure on Administrative Offenses will allow more than half of all fines to be paid at a 50% discount. This was reported in the press service of the Ministry of Justice.

“The draft procedural code of the Russian Federation on administrative offenses proposes to extend the possibility of paying an administrative fine in half to all administrative offenses, with the exception of gross administrative offenses, as well as certain administrative offenses in the field of traffic,” TASS quoted the press service as saying.

The agency said that in total in the new Code of Administrative Offenses 1,666 administrative offenses will be described. The discount will be provided for paying fines for more than 1 thousand of them.

According to the current legislation, there are more than 1800 administrative offenses, however, fines can be paid only for those that are related to the rules of the road and do not bear increased social harm - that is, 124 fines. To do this, you must pay it within 20 days.

The Ministry of Justice also said that if a copy of the decision on the fine arrived by mail to the violator more than 20 days after it was issued, the court or other body that issued the decision will restore this term. This rule is also valid in current legislation.

New CAO

The draft new Code of Administrative Offenses was published by the Ministry of Justice on January 30. The bill assumes that the code will replace the previous one from January 1, 2021, “with the exception of provisions for which a different deadline has been set.”

The new version will reduce the number of offenses. Cases on those articles that will be liquidated will be closed. It contains the draft Code of Administrative Offenses and other legislative exemptions. In particular, the maximum period of compulsory work will be reduced.

“In the new Code of Administrative Offenses it will be 60 hours instead of 200 hours in the current edition,” the explanatory note says.

The greatest resonance was caused by the part regarding the rules of the road. The new code will appear to stand for a systematic violation of the rules of operation and management of the vehicle - for this the driver may be deprived of a driver’s license for a period of one year and a half years.

Another innovation is the article “Dangerous Driving”, a fine for which will amount to 5 thousand rubles. Violation will also be considered riding on public roads "on those means that are not intended for this."

It is also proposed to significantly increase the size of fines. So, for a speeding excess of 20 - 40 km / h the driver will have to pay not 500 rubles, but 3,000. If he drove 40 - 60 km / h faster, then 4,000 (now 1,000 - 1,500), but 60 km / h and more - 5000, or deprivation of rights for 4 - 6 months.

It is proposed to increase the fine for driving without a motor third-party liability insurance policy (OSAGO) from 800 to 1000 rubles, for tinting from 500 to 1000 rubles, and for transporting children without car seats from 3000 to 5000 rubles.

One of the most significant increases in fines is for "failure to comply with the repeated legal requirement of a police officer to stop a vehicle and attempt to escape, which posed a threat to the life or health of citizens." The perpetrator of this offense will have to pay not 500 - 800 rubles, but 40,000, or lose their rights for two or three years.

At the same time, United Russia stated that they would not support this bill in its current form. According to the Secretary of the General Council of the party Andrei Turchak, the draft Administrative Code contradicts the message of the president to the Federal Assembly.

“The message was dedicated to protecting the rights and interests of citizens, caring for people. And in the new draft of the Code of Administrative Offenses, we see mainly the tightening of repressive mechanisms. This is an increase in fines, and confiscation of movable property in favor of the state, and new restrictions on traveling abroad, the introduction of almost "home arrest" for adolescents. The law is needed to prevent crime, and not to create a repressive machine or additional penalties from the population, ”the party’s press service quoted him as saying.
