Dubai Executive Council Decision No. (7) for the year 2020 regarding the regulation of appointment by the special contract system in the Dubai government has set several conditions for appointment under the special contract, the most prominent of which is that educational qualifications and specialized practical experiences are rarely obtained in the labor market.

According to Article No. (3) of the decision, the conditions are that appointment must be made under the special contract with the approval of the general manager, provided that the position and employee meet the conditions stipulated, and that the job in which appointment may be made under the special contract is required “to be of the degree jobs” 13) and above, according to the job evaluation, filling it requires the availability of scientific qualifications and specialized practical experiences that are rarely obtained in the labor market, and that it be among the central functions of the department, provided that it has an approved financial allowance within the department's annual budget.

The decision stipulated that those who are appointed under the special contract require the necessity of the availability of scientific qualifications, practical experiences, technical competencies and specialized skills required to fill the job, which would provide an added value to the department, and pass the technical and behavioral tests approved by the department.

The decision clarified that government departments, according to the private contract, must abide by several things, the most prominent of which is not appointing under the special contract until after all other means of appointment have been exhausted, in accordance with the law and the decision of the Executive Council, and the negotiation method of appointment under the special contract is followed, in terms of granting salaries, allowances and benefits Stipulated in this decision, providing the Human Resources Department with an annual report of the jobs that have been appointed in accordance with the special contract, and plans to transfer knowledge from the employee to the other employees concerned with the department.

The new decision indicated that the duration of the private contract is one year, and it is renewed automatically for a similar period, provided that the total period of the private contract does not exceed four years, with written approval from the Human Resources Department, in accordance with the criteria and controls determined by a decision of its general manager, to extend the term of the private contract After the lapse of the total period prescribed for him at the request of the Department, for a period not exceeding one year at a time.

The decision stipulated that the employee may be granted a monthly gross salary that does not exceed the end of the link for the job circle for the job grade assigned to it, in addition to a special contract allowance, at a rate not exceeding 25% of his total salary, for the job groups within the third job circle, and at a rate that does not exceed On 20% of his gross salary for job groups, within the first and second job rings, this allowance is not counted in the gross salary.

The department may also, based on justified reasons, increase the percentage of the private contract allowance, after obtaining the prior approval of the Human Resources Department, and this approval is issued in accordance with the regulations approved by it in this regard.

According to the decision, it is permissible to exchange any of the following allowances and benefits for the employee with an education allowance for three of his children under the age of 21 who have a valid residence permit from those enrolled in private educational institutions within the emirate, which is spent annually in an amount not exceeding 25 thousand dirhams per child, and providing in-kind housing or exchange Housing allowance of no more than 150,000 dirhams annually, based on a certified rental contract in the emirate in accordance with the legislation in force.

Termination of service

According to Article (10) of the Dubai Executive Council Decision No. (7) for the year 2020 regarding the regulation of appointment in the private contract system in the Dubai government, the employee’s service is terminated when several reasons are achieved, most notably job inefficiency, or interruption of work in the event of his obtaining On the result of evaluating the performance of “does not meet expectations”, whether a citizen or a non-citizen, or his absence from work without prior permission or an acceptable excuse for more than five continuous working days, or seven intermittent working days during one year.

The decision stipulated that in the event of the employee's service termination, he shall be notified in writing of that at least two months before the date specified for termination, and the department may reduce this period.

Not to be appointed under the special contract until all other means of appointment have been exhausted.

Education and housing allowances may be paid or a housing allowance paid to the owners of private contracts.
