The Constitutional Council was seized, this Wednesday, by the UNEF within the framework of the Parcoursup procedure, on the question of the communication by a university to a student union of the criteria of examination of the files of the candidates.
The Council of State agreed to transmit to the Wise Persons priority questions of constitutionality (QPC) filed by this student organization.
A precedent at the University of the Antilles
For the Unef union, the current provisions of the law, by authorizing only very limited communication of the criteria for the algorithmic processing used by universities for examining applications, infringe the right of access to administrative documents. Last June, the Council of State had annulled the judgment of the administrative court of Guadeloupe which had "enjoined" the University of the Antilles to publish the "local algorithms" used by the establishment to classify, through Parcoursup, the candidates for its licenses.
The Unef student union had asked the University of the Antilles, in June 2018, to communicate the computer documents it used for examining applications and had been refused. UNEF then brought the case to justice. For UNEF, the algorithms intervene not in the final phase of deliberation, but upstream in that of selection. The UNEF has launched procedures with several administrative courts to demand the publication of these "local algorithms" which, according to him, list the criteria defined by a university to select the graduates.
