Breanne Ayala, a resident of New Jersey, sued TripAdvisor after falling from a camel during a trip to Morocco in January 2018. This 24-year-old American woman then broke her arm. She had booked the activity on the Viator platform, which TripAdvisor owns, reports The Boston Globe . Her complaint was registered on December 30.

She claims 110,000 euros

The complainant claims financial compensation of $ 120,000 (approximately 110,000 euros) to cover her medical expenses. She believes that the safety rules were not observed during the excursion. She would be mounted on a pregnant camel which was one month before the end of her gestation. The animal ended up throwing it on the ground. Breanne Ayala had been operated on in Morocco.

She criticizes the organizers of the activity for having used animals presenting "a dangerous physical condition" and not used to transporting humans. Breanne Ayala also regrets that no instructions were communicated before the start of the course in the desert, contrary to what the platform indicated.

Viator covers itself on its site

However, Viator clearly alerts its users on its website: “Your interactions with providers are at your own risk. Viator cannot be held responsible for the acts, omissions, errors, declarations, guarantees, violations or negligence of any provider, or of any personal injury, of any death, of any material damage, or other damage or expense resulting from your interactions with a service provider ". This warning should convince the judges.
