• Jury: Cesar Adrio, guilty of murdering his former partner Ana Enjamio after months of "harassment and control"
  • The fact: Investigate the violent death of a 25-year-old girl in the portal of her building in Vigo

The Provincial Court of Pontevedra has issued a ruling in the Ana Enjamio case , in which a jury found César Adrio guilty of murdering his former partner and co-worker in the portal of his house after the company's Christmas dinner at the that both had attended. Based on the verdict of the popular court, he has been sentenced to 30 years and four months in jail.

The resolution of the fifth section of the Provincial Court of Pontevedra, based in Vigo , is blunt in describing this murder as a sexist crime and specifies that he slashed it "for his feeling of machismo and domination over it" and that he considered that she was a "woman who, if she wasn't going to be with him, wouldn't be with any other."

The magistrate president of the Jury remembers in his decision the compatibility of the application of the aggravating one by reason of gender and the one of kinship. It indicates that gender must be applied in all those cases in which it has been proven that the author has committed the facts against the female victim "for the mere fact of being so and with the intention of making clear his feeling of superiority over it." In this case, he considers the manifestations of the condemned to his ex-girlfriend significant, to which he warned that if he was not going to be with him, he would not be with another young man either. "This should infer the empowerment with which the accused felt about his victim," emphasizes the judge.

The jury concluded that he was stabbed more than 30 stabs as a climax to months of "control and harassment" after a break that he did not accept and found him guilty of the crimes of murder with abuse and cruelty, harassment and violation of privacy.

Now, the Provincial Court specifies the aggravation of gender and kinship and imposes the penalty of 25 years in prison for murder; another 20 months as the author of a crime of harassment, concurring the aggravating relationship; and three years and eight months more as the author of a crime of violation of privacy, with the aggravating relationship.

The Hearing also condemns the prohibition to communicate and approach within 500 meters of the parents and the brother of the victim for a period of more than 10 years to the prison sentence imposed, and must compensate each of the parents of the victim with 87,900; and, to his brother, with 25,400 euros .

This resolution is not firm, since it is possible to appeal against it before the High Court of Justice of Galicia (TSXG). In it, the defendant's preventive detention is extended up to half of the penalty imposed for the most serious offense, that is, 12 years and 6 months in prison, from December 21, 2016.

The events happened during the morning of December 16 to 17, 2016 in the portal of the Vigo home where the victim resided, who had coincided that night with the defendant at the Christmas dinner of the company of O Porriño (Pontevedra ) in which both worked.

"Behavior more than improper of a human being"

The Jury Court considered proven that the convict attacked his former partner in the portal with a knife and that he acted "in a particularly perverse manner, by behaving in a fierce manner and with the intention of causing him a particular and unnecessary harm." He also insists on the "defenseless situation in which the victim was facing his aggressor."

Thus, he refers to his physical superiority, to the victim's confidence, "that he did not expect such a reaction", to which he made use of a weapon since the young woman "lacked the possibility of defending herself." He believes that there is a special temperament of the accused of delighting in the suffering of the victim he was going to kill "and stresses that the body presented sliding lesions on the skin, in the thorax, which are classified as" threatening or probing injuries. "

This way of acting reflects, according to the magistrate, that César Adrio, in addition to pursuing the end of the young woman's life, wanted to cause him, "in a deliberate way", a pain that went beyond that which accompanies a violent death, " involving a kind of torture, behavior rather than improper of a human being, and this as a result of the victim's refusal to maintain a relationship with the accused.
