The County Administrative Board bases its responsibility report on the fact that the operations at the plant that dumped the barrels were in operation after the creation of the environmental bar in 1969 and that it is therefore possible to require the operator to pay for the damage that has occurred, in this case the dumped barrels.

Fortum Ljunga Kraft AB

The company that for a long time conducted the activities that caused the pollution and that dumped the barrels in the Sundsvall bay was Stockholm's Superphosphate Fabriks AB, now Fortum liquidated Ljunga Kraft AB. The County Administrative Board therefore considers that the company, as former business operators, is responsible for finishing according to Chapter 10. Section 2 of the Environmental Code.

Fortum Sverige AB

Fortum Sverige AB has taken over the properties with hydropower plants, fixed assets and other assets related to the hydropower operations from Fortum Ljunga Kraft AB. These assets enabled vinyl chloride production at Stockviksverken and have thus been an integral part of part of the actual operation of the main business. Through the takeover, the Company has also taken over the rights and obligations of the business. The County Administrative Board thus considers that the company is responsible for finishing according to Chapter 10. Section 2 of the Environmental Code.

Bygglim Sverige AB

The current PVC business was started and operated by Stockholm's Superphosphate Fabriks AB and finally transferred to Casco Nobel AB, which also discontinued PVC production in December 1988. The company continued to conduct chemical production in the industrial field. The County Administrative Board considers that Casco Nobel AB, now Bygglim Sverige AB, as the latest licensee and former operator of the PVC business at Stockviksverken also has a post-treatment responsibility in accordance with Chapter 10. Section 2 of the Environmental Code.

Shared responsibility

In summary, the county administrative board finds that the current pollution damage is a result of the PVC production at Stockvik and both Fortum Ljunga Kraft AB and Bygglim Sverige AB have been operators for this. By taking over Fortum Ljunga Kraft AB's power plant with associated fixed assets, Fortum Sverige AB has also taken over the company's rights as well as its obligations. The companies are deemed to have joint and several responsibility for the investigations of the area.

Fortum Ljunga Kraft AB, Fortum Sverige AB and Bygglim Sverige AB have, according to the County Administrative Board, a responsibility for necessary investigations of the dumping area.

The designated companies renounce responsibility and do not want to be interviewed.
