The court found that the defendant hastened to accuse the plaintiff of harassing her without evidence, which is available to him, in order to verify a copy of the abuse of the right to report crimes to the competent authorities, and that the plaintiff was injured due to the procedures he was subjected to causing psychological harm as a result of the plaintiff's act Down with the plaintiff.
The misdemeanor court fined the accused five thousand dirhams for assaulting the accused’s privacy, photographing and publishing his photos using the information technology means, where the victim filed a lawsuit in front of the total civil court demanding financial compensation for the damages incurred.

According to the prosecution’s indictment, the defendant assaulted the victim’s privacy, in other than authorized cases, took a picture and scenes of it and published it using the means of information technology, “WhatsApp”, and sent it to another person, and demanded that the public prosecutor punish it in accordance with the law against information technology crimes the average.

The suspect in the investigations confessed to photographing the victim on her phone because he was chasing her and harassing her inside a commercial center, and that she photographed it, and sent his picture to one of the investigation men so that the specialized agencies can identify him after submitting the report.

For his part, Al-Mujni stated that the accused filmed him on her mobile phone while he was in a mall, on the pretext that he was harassing her and chased him until he reached the restaurants hall, leaving the mall.
He explained that the accused continued to photograph him until he got to the parking lots, and that he knew her as a result of previous differences that were between them, where he denied during the investigations that he molested the suspect or approached her, indicating that she had published his picture through a recorded clip that made fun of him and connected through others through the "WhatsApp" program According to investigations, surveillance cameras in the car parks of the mall revealed that the accused was holding her mobile phone and was photographing and chasing the victim.

On the other hand, the defendant indicated in the civil lawsuit filed with the total civil court that the allegations made by the plaintiff did not prove any material damages incurred by him as a result of taking pictures of him, which he published on social media, and continued that the act attributed to her in the case papers relates to the incident of capture A photo of the plaintiff, not a group of photos.

She explained that she sent the image to the investigation officer, who was asked to photograph the plaintiff to identify him, and that she did not publish the plaintiff’s image through the information technology means, pointing out that there is no basis for the moral damages that caused to the plaintiff, as they are only sent statements that do not bear any evidence of their authenticity.

She added that the plaintiff did not provide the benefit of the publication of his image through the means of information technology, and there is no image for him on the basis of information technology, but the image was only sent to the investigation specialist in the incident.
On the other hand, the lawyer, Hanan Al-Bayed, requested the plaintiff from the court to compensate her client for the material and moral damages he sustained due to his arrest and detention for a period of 39 days due to the complaint received by the defendant, which was accused of harassment and pursuit in a public place, which was denied by the case papers and surveillance cameras in the place.
