19 December 2019The judge of the civil section of the Palermo court, to whom the lawyers of the NGO Sea Watch appealed urgently, ordered the administrative seizure of the ship, triggered by the investigation into which the commander is under investigation Carola Rackete, accused of resisting a public officer, damage and resistance or violence against warships.

The German captain was also arrested, only to be released by the investigating judge who had not validated the provision.

The prosecutor's office of Agrigento, on September 25th, had decided the criminal release, with a provision signed by the prosecutor Gloria Andreoli, as the probative requirements were deemed to have ceased. The ship, however, remained in the port of Licata because it was subjected to administrative seizure based on repeated violations of the prohibition of entry into territorial waters, imposed by the Italian authorities pursuant to the security decree bis which, at the time, had entered into force by few weeks.
