Khartoum the day before yesterday witnessed successive developments that open a new page in the ongoing battle between the forces of the December 2018 revolution and the ousted President Omar al-Bashir al-Ba’id’s regime, where the Appeals Court issued a ruling to deposit al-Bashir with a correctional institution, and that coincided with the issuance by the Sovereign Council of new decisions to dismantle the system’s structure, Thousands of demonstrators whose supporters called themselves "Green March" came out of pro-Bashir rallies, while the leader of the National Umma Party, Sadiq al-Mahdi, called for "national reconciliation" for all political forces and "early elections."

The judge of the Court of Appeal in Khartoum, Sadiq Abdul Rahman, issued a ruling to deposit the two-year dismissed President Omar al-Bashir for the two years of the Social Reform Corporation, and to confiscate the money in foreign exchange that was found in his possession to convict him of financial corruption and forbidden wealth.

The court had sentenced the dismissed president to 10 years in prison on charges of financial corruption before commuting the sentence for two years, according to Article (48) of the Criminal Code for exceeding the age of seventy, and the Al-Bashir Defense Commission boycotted the court during its preamble, and accused it of politicization, and the judge expelled them out of court.

For his part, the "Sudanese Professionals Caucus" considered, in a statement, "that the pronouncement of judgment in the case of the ousted president Omar al-Bashir represents a political and moral condemnation of the ousted and his regime, and the court's revelations reveal an aspect of mismanagement of the state and public money."

Tip of the iceberg

The gathering said in the statement, "The charges relate to the reasons for the arrest of the deposed person and the money seized in his possession, and that they have gone to eliminate the days of the Military Council, and before the formation of the transitional authority, they are only a tip of the spate of corruption and its height on the ground, and no more than a beginning to inventory the account." The statement continued, "This ruling is not the end of the day. Al-Bashir accusation sheets on his major crimes are being worked on by a number of committees and the Public Prosecution at various stages, which include his coup against democracy, undermining legitimacy in 1989, and all the crimes of his regime since then." The statement pointed out that «the charges that al-Bashir still faces include torture and assassination in detention centers, since Ali Fadl and even Mahjoub and Ahmed al-Khair, in addition to the ethnic cleansing and crimes against humanity committed by his forces in Darfur, according to the recommendation of the International Criminal Court, we add to it similar crimes in the mountains Nubia, Blue Nile and the South before its independence, and faces charges of killing peaceful protesters throughout his rule, in particular in the martyrs of Port Sudan, Kajbar, September 2013 and December 2018, and crimes of empowerment policy, unlawful wealth, and disposition of the sale of the state's assets, wealth, and lands a". The statement concluded, “As we value the professionalism and fairness of the litigation, which was made available to the deposed criminal from the right to defense and public hearings in the context of this trial, and it reflects the values of revolution and change, we also emphasize ensuring that the deposed person is held accountable, and that he is punished for the misdeed after the people took it, taking Aziz Muddader So he became a subservient. ”

In the same direction, and after the ruling was issued, the Executive Office of the Sudanese Public Prosecution issued a statement saying, “The Criminal Court ruling has issued a conviction of the accused Omar Hassan Ahmed Al-Bashir for the accusation against him under Article (5) and Article (9) of the Foreign Exchange Dealing Law.”

The decision also included the conviction of the defendant for the charge against him under articles (6) and (7) of the Forbidden and Reprimanding Act of 1989 in criminal case No. 40, and the court imposed a two-year prison sentence, and this sends a signal in several directions:

This is the first case in which the head of the previous regime is brought to trial, and a number of other cases await him under article (130), including willful killing, crimes against humanity, and crimes to undermine the constitutional order, and the punishment in each of them if convicted reaches the death penalty.

And that the legal status of Omar al-Bashir has shifted from the position of the accused to that of the convicted person, and accordingly is subject to prison regulations with all the restrictions imposed by those regulations.

And that the symbolism of condemnation indicates the way in which state funds were managed, and that condemnation under the aforementioned articles of a person who was president of the republic reveals a bad turnover.

And that the judge made a great effort to cause the judgment with a high professionalism, and provided an opportunity for the prosecution and the defense to present their evidence, support and legal reasons, but the behavior of the defense lawyer in politicizing the case in the court and at the pronouncement session is rejected, and it is not appropriate for a defense body in which the tools of the law are supposed to be dealt with, It is not the tools of politics, and it contradicts the code of ethics of the legal profession.

And that the condemnation under the Anti-Forbidden and Forbidden Act fell with all the chants and slogans of the allegation of cleansing, honesty and purity. And that the Public Prosecution is now investigating the crimes committed by al-Bashir and the symbols of his previous regime from 1989 until the date of the fall of his regime in April 2019 (murders of demonstrators, human rights violations, crimes against humanity in Darfur, the Nuba Mountains, and the Blue Nile, rape crimes, torture crimes, enforced disappearances , And other corruption crimes that amount to billions of dollars). And that the people of Sudan are promised promises by Al-Bashir and the symbols of his previous regime for all of the above mentioned by law. On a parallel level and at the same time, the spokesperson for the Sovereign Council, Mohamed Al-Faki Suleiman, announced the issuance of Decision 1 of the Committee to Enable Empowerment, Fight Corruption and Recover Funds, to form a committee to liquidate the dissolved National Congress Party.

Al-Faki said in a statement that the committee whose chairmanship was attributed to Attorney Taha Othman Ishaq, has broad terms of reference, and will work to receive and reserve all fixed and movable assets of "houses, real estate, vehicles, and mechanisms" that were owned by the dissolved party throughout the country.

According to al-Faki, the committee also issued its decision No. (2) to dissolve the executive office and the Sudanese Bar Association.

It also issued its Decision No. (3) to dissolve trade unions, professional associations and the Employers ’Union, and the decision includes dissolving executive offices and union councils established under the Trade Unions Act of 2010, dissolving executive offices and professional association councils established under the Law on Professional Associations 2004, and the decision also dissolved executive offices Councils of federations established under the Employers Law of 1992.

According to the decision - according to the jaws - the committee has the right to reserve real estate registered in the names of trade unions, professional associations and employers, and to reserve cars, mechanisms, and means of transportation registered in the name of trade unions, professional federations, and the employers union, and prohibit their disposal.

He said that the support provided by the resistance and free revolutionaries committees is a certain good for the transitional government, in order to be able to accomplish the tasks assigned to it.

Al-Faki concluded his statement by saying, "Today, which coincides with the anniversary of the launch of the revolutionary movement, will not pass without us taking steps to get rid of the remnants of the previous regime, and we will continue the struggles of successive generations for nearly three decades to build a free and Nazi Sudan that values justice and moves in the wheel of construction and development for us." Everyone ».

On the other hand, numbers of demonstrators, whose supporters amounted to thousands, went out on Al-Qasr Street in central Khartoum from the supporters of Al-Bashir and what they called in Sudan "Al-Kizan", in response to an invitation by unknown persons to "march green", denouncing the policy of the transitional government, and shouting slogans with loudspeakers "Freedom Peace, justice, and Islam are the people's choice. ”“ I fell, fell, Hamdock. ”

The dissolved National Congress Party denied its responsibility and called for the demonstrations, as did the same party, which was led by Hassan al-Turabi, but the leaders of the two parties announced that they would participate in it.

For his part, the leader of the National Umma Party, Sadiq al-Mahdi, demanded in a public meeting the day before yesterday in the "Damazin" forces to declare freedom and change by not "underestimating" what he called "the Islamic trend", because of his strength, equipment and money, pointing to what he described as the existence of catastrophic errors. In the practices of the Abdullah Hamduk government, while the Mahdi did not rule out the army's intervention to correct the path. Al-Mahdi called "the parties in the Sudanese political arena to the necessity of giving priority to the supreme interest of the country and avoiding the country slipping towards an unknown fate, and warned that holding early elections is the only solution to get the country out of this predicament." Al-Mahdi called on the Islamic trend to accept a national dialogue that ends with a comprehensive national reconciliation through an inclusive conference in which all the people of Sudan participate.
