December 8, 2019The news of the request made by INPS - of 124 thousand euros - against two young girls, who became orphans for the murder of their mother by their father who then committed suicide, is provoking disdain. The President of the Republic, Sergio Mattarella, even spoke on the matter and called the Minister of Labor Nunzia Catalfo for clarification.

The request made by the INPS amounts to 124,000 euros and has been advanced to the heirs, the two daughters now still minors, of Marco Lojola, 40, who on 28 July 2013 in Marina di Massa (Massa Carrara) killed his ex-wife and mother of the two little girls, Cristina Biagi and then taking her own life.

Money referring to the costs of sick pay and disability allowance paid to a 54-year-old man who was wounded by Lojola on the day of the tragedy, managing to survive six gun shots fired by him in his forties. The lawyer Francesca Galloni, the trusted lawyer of the Biagi family, explains the story, as explained by the Nation of Massa who publishes the story today. "The INPS request - explains the lawyer - is legitimate even if it is humanly difficult to understand". And if it is not fulfilled, INPS will proceed to forced recovery. For the two girls the risk is to lose their parents' home, which however does not cover the request made by INPS.

Inps: "Recovery of legitimate sums. Let's follow case"
The INPS states "to follow for some time" the case of the two minors of Massa Carrara who were orphaned after their father killed his mother in 2013 and then committed suicide. In a statement, the institute - which underlines that "it has so far been close to the Biagi family and will continue to be so" - states that the request for advanced compensation "which aims to recover the sums paid to another victim of Marco Lojola, is legitimate and bound, as recognized by the same family lawyer ". And he continues: "The forensic medical office recognized a invalidating benefit and considered that there was a causal link between the injuries sustained by the insured and the injury caused by Lojola, ex-husband of the victim's partner, for which the INPS is held , pursuant to the legislation in force, to recover the sums ".

Moreover, INPS continues, "given the particularity of the matter from a human point of view, in 2017 the Massa Carrara Headquarters, before sending a letter aimed at interrupting the prescription, took care to contact the recipients of the letter, with the "Commitment not to activate any legal action for compulsory recovery for the moment. The Massa offices have also supported the family for each INPS benefit due. In October 2019, the institute says," the Offices had to send a second warning interruption of the statute of limitations, without however putting in place any judicial action for the forced recovery of the credit

So far - explains Inps - an attempt has been made to operate with maximum tact and, as mentioned, the letter has been announced aimed at interrupting the prescription pending the identification of a solution which, in compliance with the law, takes into account the particular situation of the two minor heirs. In the next few days, the leadership and the local lawyers will resume contact with the family lawyer to identify a solution that will balance the legality and the family situation ". The INPS" does not consider instead to comment on the accusations made by a relative of the minors , in the human understanding of a particular state of mind ".
