The defense attorney for José Enrique Abuín Gey, El Chicle , now recognizes, at the last session of the trial for the illegal detention, sexual assault and murder of Diana Quer at the Provincial Court of A Coruña , that her client was able to commit a wrongful killing. In his initial conclusions he asked for the only defendant a crime of manslaughter due to recklessness and a penalty of two and a half years in prison, but in his final conclusions he introduces an alternative qualification, that of "homicide with eventual intent" and a higher penalty of Five to seven years.

The lawyer, Fernanda Álvarez Pérez , made this modification in the final conclusions phase of the trial based on the evidence that was presented in the nine days of trial, specifying that this alternative qualification could be applied to the defendant in the event that the members of the Jury consider that the accused had to be aware of the force he was doing when, as he acknowledges, he approached Diana Quer in A Pobra do Caramiñal , and throws his hands around his neck.

In her final conclusions, the lawyer continues to insist that her client's intention was not to kill Diana Quer, but that she surprised him by stealing diesel and, out of fear, attacked her and ended up suffocating. The fundamental change is that he recognizes that El Gicle may have been aware "of the possibility of causing death", although he continues to maintain that in the case of his client, the jury must take into account the qualified attenuating circumstance of confession.

The Prosecutor's Office and the private prosecution maintain their conclusions that El Chewing gum should be convicted of sexual assault, illegal detention and murder with alevosía, cruelty and to prevent the discovery of another crime - sexual assault -, although they slightly modify their factual account "in light of what we have seen."

Thus, they introduce nuances about the physical constitution of the accused and the victim, which would prove the superiority of the first over the second, and insist that in 500 days he said nothing of the whereabouts and that although he had not said where the body was, the Civil Guard would have found it equally. This last argument is focused on avoiding the mitigating confession.

Prosecutor Cristina Margalet and the prosecution attorney, Ricardo Pérez Lama , also insist that in this case an aggravating circumstance of cruelty concurs.

The trial session is witnessed by Diana Quer's parents, Diana López Pinel and Juan Carlos Quer , who insist that the defendant should be sentenced to the reviewable permanent prison sentence.

The father also believes that it is no accident that this trial ends in 25-N, a day against sexist violence, and insists that the "greatest demonstration" of all those held on this day in Spain will be "the one that is lived today in this view room. " He adds that "there was no more explicit than that of my daughter, who paid with her life to defend her integrity as a woman."
