The holder of the Court of Instruction Number 41 of Madrid Juan Carlos Peinado has agreed the imputation of journalists from EL MUNDO, El País, ABC, El Confidencial, La Vanguardia, El Español, Cadena Ser and RTVE for publishing information of public interest on the summary of the members of the Defense Committees of the Republic (CDR) arrested and imprisoned for terrorism by order of the National Court. Peinado has agreed the imputation of media professionals without previously obtaining a report from the Public Ministry, as this newspaper has learned.

The instructor has summoned on November 29 several journalists to testify as investigated for a crime of revealing secrets for revealing public interest data on the members of the CDR who intended to commit terrorist actions in Catalonia and assault the Parlament on the day that the Supreme Court notified the sentence of the process, the so-called "D-day". This information was published when the proceedings were under summary secret.

The holder of the Court of Instruction Number 6 of the National Court, Judge Manuel García Castellón, referred to the courts of Plaza de Castilla the complaint that seven members of the CDR filed as a result of various media accessing the unconditional prison car of those investigated.

The doctrine of the Constitutional Court is clear when it emphasizes that "truthful information regarding matters of general interest or public relevance is given special constitutional protection, a requirement that derives both from the content and the purpose of the right recognized in art. 20.1 d ) of the Constitution ".

Likewise, the court of guarantees, through a multitude of sentences, has declared that "an information has public relevance because it serves the general interest in the information, and it does so by referring to a public matter, that is, to facts or an event that affects all citizens ".

On the other hand, the Constitutional has stressed that "the exercise of fundamental rights to freedom of expression and information guarantees a relevant constitutional interest: the formation and existence of a free public opinion, a guarantee that is of special importance since, being a prerequisite and necessary for the exercise of other rights inherent in the functioning of a democratic system, becomes, in turn, one of the pillars of a free and democratic society. "
