As the interlocutor explained, on November 19 the Ostankino District Court of Moscow postponed the consideration of the criminal case at the request of his lawyer, who did not have time to familiarize himself with the case file.

Cabrera tried to sell two bulbs with an integrated camera, which he used to watch his child at home.

A man bought them in an online store, but soon decided to sell them as unnecessary. The buyers, he said, were FSB officers.

“First, they called me three times and asked if the camera was hidden or not. I explained that the camera is not hidden, it is noticeable. We met with customers, I handed over the camera, and they gave me money. After me, four law enforcement officers surrounded me and said that I was breaking the law, ”Cabrera said.

According to him, camera bulbs are not spyware: such "baby monitors" are sold in many online stores.

“I did not try to independently upgrade the devices in such a way that it was possible to imperceptibly conduct video shooting,” he notes. - It is impossible to use these cameras for covert surveillance, because when you turn on the device, a bright LED indicator lights up and a loud voice signal is also triggered. Nevertheless, the expert preparing the conclusion on these devices came to different conclusions. ”

As a result, a criminal case was instituted against Cabrera under Art. 138.1 of the Criminal Code of Russia ("Illicit trafficking in special technical means intended for secretly obtaining information"). A man faces up to four years in prison and a fine of up to 200 thousand rubles.

In August, amendments to legislation entered into force that protect against criminal prosecution of citizens who bought such “tacit surveillance devices” for domestic use.
