"The evidence" is that ArcelorMittal "did not comply with the presented business plan", which provided for 6 million tons of steel and not four. Thus the Minister of Economic Development, Stefano Patuanelli, at a press conference on the Ilva affair.

"This is a certain fact", said Patuanelli, pointing out that ArcelorMittal "participated in a European tender subject to several offers received, in this case two", which were evaluated in their "binding offer" based on four elements: price, sources of financing, industrial plan and environmental plan. "Compliance with the business plan is a contractual element," he remarked.

"We believe that even for an environmental issue production continuity is necessary, because without production there is no environmental plan" continued Patuanelli. "We must guarantee this path: I do not believe that we will achieve this because the conditions are not there, but if there is a withdrawal, the commissioner will have to guarantee it. Our position is that Mittal must return to guarantee the implementation of the business plan".

"Article 27.5 of the agreement talks about changes to the Dpcm and changes to the environmental plan that make it impossible to apply a business plan, which is certainly not the case in question," the minister specified. "We can discuss whether we have given an alibi or not, but it is unthinkable for those who are in good faith that from one day to the next a company, with a decision clearly taken well before November 4th, has decided to leave because we have removed the shield".

Denied the hypothesis 'shield in time'
"Time shield? The note of denial of the M5s leader in the Senate is very recent" replied the minister, referring to press rumors, according to which yesterday an agreement was reached in the M5S house on the possibility of a criminal shield to time, provided that Mittal returns to negotiate.

Patuanelli hopes that ArcelorMittal will retrace his steps. If this were not the case, "it would be the legal battle of the century - he indicates during a press conference - and we hope for a glimmer of wisdom that will lead ArcelorMittal to more gentle advice.
