What a few months ago seemed completely impossible, since this Tuesday is already a reality. Pedro Sánchez and Pablo Iglesias have achieved a coalition government agreement. The political machinery starts up .

The 350 seats in Congress are already awarded . The parties with parliamentary representation will start from now on a very complicated trip, that of the investiture, with a mandatory stop: the constitution of the Congress and the Senate on December 3. What is the way to go from now on? What will happen?

Nov. 16

As of November 16, once all the appeals are resolved, the results will be proclaimed and the electoral boards will be issuing the credentials so that the deputies and senators can appear in Congress and in the Senate to be accredited. The parade of the new parliamentarians to do the 'paperwork' is expected from Monday, November 18.

November 18th

It is the date from which the 350 deputies and the 208 senators elected on 10-N will begin to go to the Chambers to complete the procedures that allow them to take possession of their seats .

It is a kind of unofficial beginning of the legislature . The elect go to Congress and the Senate to deliver the credentials of the provincial electoral boards, and also to declare their assets, give information about their quotes, take photos of their profiles and receive mobiles and electronic tablets.

During these days, in addition, parties with parliamentary representation will begin to talk about the compositions to be given to the Bureau of Congress and that of the Senate .

December 3

At 10:00 a.m., the Congress and the Senate are constituted simultaneously, each at its headquarters. It is the day when parliamentarians elect the presidents and the Chamber Tables and promise or swear the Constitution.

That same Tuesday, the person who occupies the Presidency of the lower house will move to the Palacio de la Zarzuela to inform the King so that he can open a round of consultations with the parties represented in Congress to decide who is responsible for submitting to the Investiture session.

The king will know this day, after the session, that the fourteenth legislature of democracy has begun , but it is likely that he will have to wait a few days to know the solemn opening date, which he is attending.

It would have to be square in the following fifteen days, as stated in the regulations of the Congress, but the usual uncertainty of the political landscape usually leads the Bureau to postpone it .

The machineries of the Congress and the Senate will begin to carburete: constitution of the groups , assignments of seats , distribution of offices of the deputies , and so on.

December 12th

It is estimated that this date will end the period of five working days to form the parliamentary groups of the Chamber , following the regulatory provisions. That period begins after the constitution of the Chamber and takes into account that there are two holidays in between: December 6, Constitution Day, and December 9, since in Madrid the holiday of the Eve , Immaculate Conception Day.

Then, the Bureau of Congress must ratify the parliamentary groups to constitute the Board of Spokespersons , which is the body that orders the plenary sessions and, therefore, the Investiture Plenary, when convened.

Achieving their own group requires over 15 seats , and if this is not the case and they add more than five, they must request 15 percent of the votes in the constituencies in which they have been presented or 5 percent of the total votes at national level .

The procedure is important: on the one hand, because it allows the collection of subsidies that Congress and the Senate give to the groups created; on the other, because it allows the president of the lower house to communicate to the king which parties are in the chamber to initiate consultations on the investiture, as long as a candidate has decided to take the step.

Week of December 16

Once the parliamentary groups and the Board of Spokesmen are constituted, plenary sessions can be called . If there is agreement between some political forces and taking into account the wishes expressed by the President of the Government in office, Pedro Sánchez , it is estimated that the Investiture Debate could be held, at the earliest, that week of December 16. The candidate who obtains the confidence of the Congress by one of these two ways will be invested president: in the first vote adding the absolute majority (176 deputies) or, in a second opportunity, 48 hours later, obtaining more votes in favor than against .

In order to fix the date of that first investiture vote, the risk of a new electoral repetition must be taken into account , since, in the event of a blockade, the Courts will be dissolved after two months of that date are held to hold elections 47 days later. And since it is customary to vote on Sunday the date of that plenary session should be chosen counting on that in this transit there are two consecutive months of 31 days (December and January) and a month of February with 29 days.

Two scenarios

  • Christmas Eve : If the investiture has been achieved, the new President of the Government could take office the weekend before Christmas and immediately appoint his ministers. With an Executive already in the blue bank, the Solemn Session of the Legislature, presided by the King, can be held, which is not expected until January.

    In any case, the appearance of the new ministers in their respective committees of Congress to present their plans may not be held until mid-January. First, the parliamentary groups must reach an agreement on the composition of the commissions, then they must be constituted and then the Congressional Board must expressly authorize them to meet, given that January is unfit for parliamentary purposes according to the Constitution.

  • Mid-February : On the contrary, if the investiture has not been achieved in that debate, after the first failed vote, a period of two months begins for possible new attempts. That implies that, if there is a failure in mid-December - as happened with the failed investiture of Pedro Sánchez in March 2016 and July 2019 - and if a viable alternative is not achieved in the two following months, the Cut again in mid-February to end up holding new elections, as soon as April 5.
