The system must be legally safe. Equal to everyone. But "Magnus" from Nyköping has received three very different messages. For seven years he received activity compensation. The Social Insurance Office did not consider that he had any work ability at all. Slowly, "Magnus" began to feel better. He built up his life, started exercising and cooking and lost weight.

But when he turned 30, he had to apply for sickness benefit, and then the Social Insurance Office assesses not only his ability to work one year ahead, but for the rest of his life.

The Social Insurance Office went against the doctor's assessment

"Magnus" got rejected. The Social Insurance Office assessed that he could work full time in a regular job in the open labor market - even though his doctor had written the opposite in the medical certificate.

- They ask one to arrange medical certificates, but they still do not care what is there, says "Magnus".

Changed their mind

But "Magnus" mother appeals the decision to the administrative court. But before the court has decided, she also makes a new application to the Social Insurance Office - on the same grounds.

And this time, just a year later, the Social Insurance Office is changing. They now believe that "Magnus" has no work ability at all.

"The situation is the same"

- Either it was because we turned to the media. Or it was that I called the manager and the decision maker. I see no difference now and on all the certificates we sent in earlier. The situation is the same. But when they read the latest certificate they just changed the decision, says Susanne Eriksson, "Magnus" mother.

She does not understand how Försäkringskassan can arrive at such completely different decisions.

Magnus's mother does not understand how it can be like this:

- First, the ability to work was completely reduced for seven years. And then all of a sudden, on his 30th birthday, he had full work ability. Then he would look for a job. Nevertheless, he has made several work assessments at the Employment Service, which shows that he did not manage to do so. And the Employment Service wrote him out of there. So then I felt: My God where is he going to find a job then?

But then Susanne Eriksson sent a new application for sickness compensation to the Swedish Social Insurance Agency.

- Then I first learned that the medical certificate had disappeared, it had ended up in the wrong department. But then they found the paper and called. They changed the decision. But the state of "Magnus" has not changed. It is exactly the same as it was a year ago. The only thing that has changed is that I have sent another certificate.

The Court decides

The Swedish Social Insurance Agency changed the decision, but did not want to pay out money retroactively for last year. The authority maintains that "Magnus" was fully employed when he was 30 and therefore not entitled to any money. But now, when he is 31, he is entitled to compensation.

- Now the question for deciding lies in administrative law. But the wait there is 13 months. So "Magnus" has to wait for his money.
