The Abu Dhabi Court of Cassation has overturned an appeal judgment that punished the formation of a gang of seven accused of forcibly stealing a money exchange company, each with a five-year prison term, and decided to set a hearing for the parties to announce.

The Public Prosecution has charged the seven defendants with the theft of cash owned by the exchange company, coercion and threats against the employees of the company, in addition to the formation of a gang concerned with armed robbery, storming the exchange shop and threatening those with weapons, and seizing cash owned by others and fleeing the looting.

The Court of First Instance ruled in the presence of the defendants from the first to the fifth and in absentia against the sixth and seventh to punish each of them with imprisonment for 15 years, and deportation from the state, and confiscation of the tools used in the crime and bind them to fees, so the convicts appealed to the verdict, and the Court of Appeal in Abu Dhabi in presence In the matter, amending the appealed judgment and merely imprisoning each of the appellants for five years in order to steal by coercion and to support it, except that they are obliged to pay fees.

The appellants mourned the shortcomings in the cause and the breach of the right of defense, as their defenders had to appear before the Court of Appeal to annul their confessions, as they were the result of coercion, but the appealed verdict turned away from their defense despite its intrinsic nature, which is flawed and must be reversed.

The decision of the Court stated that the decision in the Court of Cassation to pay the nullity of the recognition of its issuance under threat and coercion is a substantive payment, which must be discussed by the trial court and to respond to the fall, as long as the verdict has been based on the recognition of that confession, and the court ruled to overturn the contested judgment and determine a hearing For consideration of the subject announced by the parties.
