March 02, 2019A 'emotional storm' caused by jealousy can mitigate the responsibility of those who kill. Also on the basis of this reasoning the Court of Appeal of Bologna has almost halved the sentence to Michele Castaldo, 57, homicidal offender confessed to Olga Matei, the woman with whom he had had a relationship for a month and who strangled with bare hands on October 5 2016 in Riccione (Rimini).

At first instance he was sentenced to 30 years by the Gup of Rimini, for murder aggravated by abject and futile reasons. At the Court of Assizes of Appeal of Bologna, the prosecutor Paolo Giovagnoli, in the hearing of November 16, had asked for confirmation of the sentence. But the judges, while acknowledging the aggravating circumstance, reduced the sentence to 16 years, granting generic extenuating circumstances.

In the sentence, recently filed, it is explained that the decision derives primarily from the positive evaluation of the confession. Moreover, we read in the act, although the jealousy felt by the accused was a feeling "certainly unmotivated and unsuitable to invalidate his capacity for self-determination", however it determined in him, "because of his unhappy life experiences" that that the psychiatric expert who analyzed him called it an "overwhelming emotional and passionate storm", which, in effect, "manifested itself immediately afterwards with the theatrical suicide attempt". This condition "is likely to influence the extent of criminal responsibility".

And so the sentence (life imprisonment, reduced to 30 years for the abbreviated rite) has passed to 16 years (24 years, reduced by a third always for the ritual) for a brutal murder that happened after a dispute between two people who frequented each other little.
