The manager of Magrudis, José Antonio Marín, ordered the destruction of company information, in addition to products suspected of being contaminated, in the midst of listeriosis crisis. The orders he gave his employees for this have been recorded thanks to the punctures of his phones while his steps were closely followed by the Central Operating Environment Unit (Ucoma) of the Civil Guard.

Specifically, on September 13, when deaths and abortions had already taken place and there were dozens of hospitalized people, Marín gave two of his employees telephone instructions to delete documents and data from society as well as to throw some of them in the trash. of the products made by it and that could be contaminated, some tubs that, precisely, had collected for that reason. And this was not the first or the only time.

This is what Judge Pilar Ordóñez realizes in a car issued on Tuesday in which he agrees to keep both José Antonio Marín and his son Sandro, who appeared in the papers as the sole administrator, in jail , communicated without bail. the owner, of Magrudis.

The magistrate of the Court of Instruction 10 of Seville recalls that, in addition, Marín and his son have already hidden information from the health authorities and not once, but several times. Specifically, on August 14, information was requested for the first time, they were asked for a distribution list and a list of customers who delivered incompletely and, after new requirements, gave a list of suppliers with little data to track the products They sold.

On August 17, three days later, those responsible for Magrudis directly refused to give more information. Moreover, they hid the existence of the white mark that was discovered on August 21, as well as information "essential to prevent people from continuing to consume infected products", hiding, for example, the manufacture of chorizo ​​until July of this year.

The destruction and concealment of information, and the risk that they can do it again, is one of the reasons why Judge Ordonez orders that both the Magrudis manager and his daughter remain in prison. But there is more.

The judge believes that it is possible that, if released, the two defendants escape , given the high penalties they face and although they may have, the magistrate does not deny it, family roots.

For the magistrate, the "rational" indications of crime are "indisputable" both in the case of the father and in the case of the son.

As far as Sandro is concerned, he flatly rejects that, as he alleges, he was a mere testaferro who merely carried out his father's orders. Nor does he accept the argument that he did not know the protocols and that, in any case, he adds, does not exempt him from liability, as well as in regards to the administrative procedures that the company did not comply with and were mandatory to carry out the activity.

Moreover, Sandro says the known car on Tuesday, he knew the existence of the white label and that other products were manufactured or manufactured, such as chorizo, data that, like his father, hid from the health authorities once the Listeriosis alert.

José Antonio Marín "was the real boss " of Magrudis, but "always" helped by his son.

He criticizes him for not taking measures since February, when the analyzes commissioned by the company were already positive. It was, says the judge, "common sense", but simply threw away the contaminated lot, without adopting "the smallest measures and precautions" to prevent infection that spread and ended up causing three deaths and seven abortions , as well as more than 200 affected. Neither launched a plan to ensure the safety of its products, nor did it apply a factory cleaning plan or put in place any type of correct measures. He didn't even tell his workers.

The businessman distributes blame

For its part, the head of Magrudis is not considered solely responsible for the outbreak of listeriosis caused by the consumption of their shredded meat. As the car of the Court of Instruction 10 of Seville picks up, Marín Ponce distributes blame , in equal parts, with the Junta de Andalucía and with the City Council of Seville. To the first for not having carried out any inspection and to the second, for not detecting anomalies in the revisions that it did in 2016 and 2017.

The version of the main defendant is that the contamination of the meat occurred in the post-manufacturing handling and due to lack of adequate conservation measures and that, in any case, he removed the contaminated lot with his son Sandro.

The son, on his side, has tried to present himself as a front man who signed what he was told but had no decision - making capacity in the company.
