The Plenary of the Criminal Chamber of the National Court has admitted Friday to remove Judge José Ricardo de Prada from the court that will judge the so-called box b of the Popular Party.

According to legal sources, by 8 votes to 7 the criminal magistrates have accepted a challenge that the formation of Pablo Casado and the former treasurer of the PP, Luis Bárcenas, filed against the magistrate architect of the harshest expressions of the sentence that overthrew the Government of Mariano Rajoy.

De Prada himself, in the context of this incident of challenge, admitted that there could be doubts about his "appearance of impartiality" to judge the cause of the so-called Bárcenas' papers although he refused to voluntarily depart from it.

The aforementioned magistrate is credited with statements contained in said judgment, which indicated that the PP had "a financial and accounting structure parallel to the official, whose items were recorded informally, sometimes on simple handwritten sheets such as those corresponding to the defendant Bárcenas, in the that were recorded income and expenses of the party or in other cases, amounts delivered to relevant people of the party. "

For its part, the Plenary has rejected by 10 votes five to separate De Prada from the Gürtel Boadilla piece.
