Francisco Franco's family presented this Thursday before the Third Chamber of the Supreme Court a request for clarification of the sentence where the endorsement is given to the acting Government of Pedro Sánchez to exhume the remains of the dictator of the basilica of the Valley of the Fallen.

According to legal sources to EL MUNDO, the grandchildren of the leader have addressed the High Court to specify whether the Executive can proceed to exhumation despite the fact that there is no express consent of the prior of the Benedictine community to carry it out.

The same sources explain that, when presenting a clarification of sentence, the High Court ruling is suspended - the resolution cannot be executed - until the Fourth Section of the Contentious-Administrative Chamber responds to the request of the Franco family.

On the opposition of the prior to exhumation, the Supreme Court ruling specified that the Government will not violate the Agreement with the Holy See when carrying out the exhumation of the former head of state. The magistrates argued that the Council of Ministers recognizes that they must have ecclesiastical authorization to access the Basilica of the Valley of the Fallen. However, article 1.5 of the aforementioned agreement with the Vatican does not deny the Executive's competence to decide on the exhumation, and to the extent that the prior administrator's refusal to authorize entry rests on the opposition of the relatives and refers to the decision now adopted by the Supreme Court, "that denial falls after this sentence."
