27 September 2019There is an agreement between the government forces to approve the reform of the justice system by the end of the year, one of the issues over which, last summer, the break between the M5s and the Lega was consummated and which represents one of the most important issues on the political agenda for the coming months. On the summit table held this morning at Palazzo Chigi, led by Prime Minister Giuseppe Conte, the central points of the draft that the Guardasilli, Alfonso Bonafede, presented on July 31 to the Council of Ministers were discussed: a more rapid justice with the halving of the times of the trials and new norms for the superior Council of the magistracy after the scandal emerged from the inquiry of Perugia.

The agreement is there
Both the current Minister of Justice and his predecessor in Via Arenula, Andrea Orlando, now Deputy Secretary of the Democratic Party, at the end of the meeting spoke about sharing the objective of reaching faster criminal and civil trials (with a maximum duration of 4 years for those penal, which becomes the media for civil proceedings) and a radical reform of the self-governing body of togas, with a new incompatibility regime to break the links between politics and the judiciary and put an end to the degenerations dictated by the currents.

Differences over the election of the CSM
On one point, admits the Guardasigilli, there is a divergence which needs further study and concerns a non-secondary topic: the hypothesis of reforming the electoral system for Palazzo dei Marescialli by introducing a draw, albeit limited to a phase, for the togates who will sit on the Council.

Bonefede: a revolution starts
Bonafede says he is satisfied and convinced that he has started a revolution for justice. The commitment is to work on a new governmental delegation bill to be approved by December 31st (coming into force on January 1st) of the new prescription, approved with an amendment to the 'Brushbreaking' law last year, which provides for the terms to be stopped after the first instance sentence. "There is no objective to change the prescription reform", confirmed Bonafede.

Interceptions
Sooner or later it will be necessary to resume work also on the regulation of interceptions. A topic that has not been discussed today and which represents a central political point of view: the current Guardasig, immediately after taking office on the Via Arenula dicastery in the summer of 2018, blocked the reform launched by the previous government (and therefore right from Orlando) with the aim of wanting to present quite different legislation. Since then, with some postponements, the Orlando reform was halted and the Ministry of Justice was set up to work out new rules.

Salvini's justice
On the day of the government summit, the leader of the League, Matteo Salvini, live on Facebook, once again talking about justice: "The country needs a justice reform, but not as Pd and M5s think," he said, explaining that he has in mind foresees "certain times and short processes" and respect for the "principle that those who make mistakes pay, even if the judges do".
