Suicide aid is permitted in cases such as those of Dj Fabo. The Constitutional Court has ruled that under Article 580 of the Criminal Code, under certain conditions, "who facilitates the execution of the suicide intention, autonomously and freely formed, of a patient kept alive by life support and affection treatments from an irreversible pathology, source of physical and psychological suffering that he considers intolerable but fully capable of making free and conscious decisions ".

Indispensable intervention of the law
Pending an "indispensable intervention of the legislator", the Constitutional Court "subordinated the non punishment to the respect of the formalities foreseen by the law on the informed consent, on the palliative care and on the continuous deep sedation (articles 1 and 2 of the law 219/2017) and verifying both the required conditions and the methods of execution by a public institution of the National Health Service, having heard the opinion of the territorially competent ethics committee ".
