HH Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE and Ruler of Dubai, has issued Law No. (5) of 2019 on the Irada Treatment and Rehabilitation Center in Dubai. Rehabilitation of people suffering from the scourge of addiction, encouraging them to be treated at the center, and participating in the prevention of community members from all forms of addiction and the risk of falling into it.

- «Center» provides treatment and rehabilitation to the owners of the will, and contributes to the prevention of society from addiction and falling into it.

- The addict for treatment or rehabilitation shall be deposited at the Center by virtue of a judgment or decision of the Court or the Public Prosecutor of the Emirate of Dubai.

His Highness Sheikh Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai and Chairman of the Executive Council, issued a decision to form the Board of Directors of the Center, chaired by Mohammed Abdullah Falaknaz, and the membership of: Director of the General Directorate of Narcotics Control in Dubai Police, Vice President and Executive Director of Rashid Hospital In Dubai Health Authority, Abdullah Dhaen Obaid, Samira Mohammed Al Rayes, Alia Hamad Al Marri, Executive Director of Irada Treatment and Rehabilitation Center, and representatives from the Community Development Authority in Dubai and Dubai Public Prosecution for a renewable three-year term.

The objectives, set by Law No. 5 of 2019, include: Raising awareness and guidance to community members about the dangers of addiction, participating in the social integration process of willers and depositors recovering from addiction, as well as contributing to supporting and encouraging families of willers and depositors. They have the need to treat and rehabilitate their parents of addiction.

The law gave the Irada Center a set of powers, including: Participating in the development of policies and strategic plans for the treatment and rehabilitation of addiction in the Emirate, in coordination with the Dubai Health Authority and the competent authorities, and the preparation and development of specialized programs in everything related to the fight against addiction, treatment and rehabilitation In accordance with the best international practices in this regard, and to provide treatment and rehabilitation services of addiction to the will and depositors, whether adults or minors, in accordance with the capabilities available to the Center and the controls adopted under this law and decisions issued by Guetdah, and in accordance with applicable legislation and policies adopted in the emirate.

In accordance with the law, the Center specializes in providing a healthy, safe and appropriate environment for the people of will and depositors, and integrating them into the community, through the integrated programs of care, training and empowerment organized by the Center in coordination with the competent authorities, and the establishment of partnerships with local, regional and international bodies competent in the field of work of the Center, and coordination with them in Preparing and qualifying specialized national cadres in the field of prevention, treatment and rehabilitation of addiction, coordinating in this regard with the competent authorities, and other relevant bodies inside and outside the country, as well as preparing specialized studies and research. In this area, and benefit from the results and outcomes in achieving the goals of the center.

The Center has the right to organize seminars, conferences, courses, training programs and workshops related to its work, issue publications and publications that contribute to the achievement of its objectives, and import drugs, devices and equipment for the treatment and rehabilitation of addiction after obtaining the necessary approvals and permits from the competent authorities, and keeping them in the appropriate places, and coordination with the Court. In addition to collecting donations for the Center, in accordance with the legislation in force in the Emirate of Dubai.

The law stipulates that the organizational structure of the center will be composed of a board of directors, whose members are appointed by a decision of the chairman of the executive council of the emirate of Dubai, in addition to an executive body consisting of the executive director of the center and a number of technical and administrative staff. The Executive Director of the Center shall be appointed by a resolution issued by the Chairman of the Executive Council of the Emirate of Dubai.The Executive Director of the Center shall be responsible before the Board of Directors for the execution of the functions entrusted to him by this Law, the resolutions issued pursuant thereto, and the legislation in force in the Emirate, as well as the duties assigned by the Board.

The Center provides treatment and rehabilitation services for addicts and applicants who are nationals of the United Arab Emirates, in accordance with the provisions of this Law and the decisions issued pursuant thereto, and the policies, regulations and regulations adopted by the Center in this regard. The Center may provide treatment and rehabilitation services for addicts to non-nationals of the State, in accordance with the conditions and procedures adopted by the Center's Board of Directors in this regard, for financial allowances determined by the Center.

The law shall regulate the admission, placement and removal from the Center, whereby the willer shall be admitted to the Center for treatment or rehabilitation in accordance with the procedures set forth in this Law and the controls adopted by the Center in this regard. The addict shall be deposited for treatment or rehabilitation at the Center by virtue of a judgment or decision issued by the competent court, or a decision by the Attorney General of the Emirate of Dubai, at the request of the competent judicial authority or the competent chief prosecutor.

The duration of enrollment or placement in the Center for treatment or rehabilitation shall not exceed two years. The applicant or applicant shall be removed from the Center in the event of an order from the competent court, after taking the opinion of the Dubai Public Prosecution with respect to the applicant, if the competent court determines from the report of the Center that his condition If the applicant requests exit and has obtained the approval of the Center. The applicant or applicant shall be removed from the Center by order of the Public Prosecution in Dubai for the applicant or owner of the will, who shall be attached or deposited at the Center, through the competent judicial authority, or by a decision of the Center for the owner of the will.

The law obliged all government entities, in the Emirate of Dubai, and the competent authorities, to cooperate fully with the Center and provide the necessary support to enable it to achieve its objectives and carry out the functions entrusted to it under this law and the decisions issued pursuant thereto.

The Chairman of the Board of Directors of «Irada» Center for treatment and rehabilitation, in Dubai, the necessary decisions to implement the provisions of this law, provided that the law replaces Law No. (5) of 2016, on the establishment of Irada Center for treatment and rehabilitation. Any provision in any other legislation shall be repealed to the extent that it contradicts the provisions of this law, provided that decisions and regulations issued pursuant to Law No. 5 of 2016 shall continue to be applied to the extent that they do not contradict the provisions of this law until the issuance of resolutions and regulations. That they replace.

His rights will

The law specifies the rights enjoyed by both the will and the applicant, including: receiving the medical and psychological care necessary to complete the treatment and rehabilitation of addiction professionally and with respect. And provide a healthy and favorable environment during treatment. Participate in training programs, courses, events and activities organized by the Center, in accordance with the regulations and policies adopted by it in this regard. And provide appropriate privacy. Following up on his affairs and allowing him to communicate with his family members and others by the means available. A statement of the rights prescribed for him and the duties imposed on him and his family members for the duration of his stay in the Center. In addition, he was briefed on the regulations of the Center, the methods of treatment and rehabilitation of addiction and the options available in this regard.

Filing the criminal case

The law affirms that the criminal case shall not be filed against the owner of the will every time his application to be admitted to the Center is approved, except in the case where he refuses to deliver his narcotic substances, or he is not committed to the program or treatment plan prescribed for him at the Center.

Confidentiality of the information

All information and data of the owners of the will and the depositors shall be considered confidential. No member of the Board of Directors of the Center, employees of the Center or any other person related to the Center may disclose, disclose or use it to third parties, except with the written consent of the owner or the applicant. , By order of the Public Prosecution in Dubai, or by a judgment or decision issued by the competent court, or at the request of any competent government authority to take care of them after they leave the center.
