43-year-old Lyudmila P. (the name of the heroine was changed) arrived in St. Petersburg four years ago - her eldest children, son and daughter, entered universities and the woman decided to help them settle in a big city. Soon she met a man, began a life together.

As RT told Lyudmila herself, in 2017 she did a pregnancy test.

“The test showed a positive result. I turned to the antenatal clinic, passed the tests, but the pregnancy was not confirmed, instead, the doctors were shocked by the terrible news that I had a positive analysis of form 50 (HIV) and recommended to be tested at the AIDS Center, ”recalls Lyudmila.

At the same time, according to her, doctors said that, in principle, the test result is dubious. The second analysis, submitted anonymously, was also questionable. It is the word “doubtful,” the woman assures, that made her critically relate to the diagnosis.

“If he is, then why is the result dubious. So something is wrong with my blood, with hormones. In addition, I went on the Internet, and there ordinary people and academics write that there is no virus, and everyone dies not from AIDS, but from the hardest therapy that was previously used to treat cancer patients. And I decided that I wouldn’t poison myself, I don’t have anything, and I calmed down, ”recalls Lyudmila.

In the fall of 2018, Lyudmila P. became pregnant. In a paid clinic where she had an ultrasound scan, the doctor informed the woman that the pregnancy was developing well. However, when she registered with the antenatal clinic, Lyudmila was again informed that she had HIV-positive status and offered to register with the AIDS Center.

At the same time, the doctor herself, according to Lyudmila P., said that she, as a specialist leading a pregnant woman, “to the bulb, whether she will be registered at the center or not.”

“However, in my map on the first page there was a checkmark opposite the column“ HIV ”. I was at home when the contractions started, and I told the doctors who came to the call that I was diagnosed with B23 (A disease caused by the human immunodeficiency virus, manifested in the form of other conditions. - RT ). Why I was brought to a regular hospital, I don’t know, ”the woman recalls.

According to her, in the maternity hospital, doctors asked the ambulance team why they brought HIV-infected to them.

“When I gave birth, they put a child on my stomach, I wanted to hug him, but they forbade me to touch him with my hands,” says Lyudmila.

The interlocutor insists that neither before pregnancy nor after childbirth no one bothered to explain to her the need for antiretroviral therapy.

“When I gave birth, they told me that my child is healthy, but he needs to be given therapy. In my mind, therapy was poison, and I asked not to give it to the child now, as he is weak and needs to get stronger. In response, they brought me a form, the contents of which I do not remember, ”says Lyudmila.

So, according to her, she signed the refusal to treat the child. And on the second day, the hospital’s doctors turned to the custody of the Zvezdnoye municipality in the Moscow region of St. Petersburg, as the woman in labor tried to breastfeed the child. As the interlocutor herself explains, she was not offered a mixture.

“A doctor came to me and woke up a child who had previously slept. The kid began to scream and I, in order to reassure him, picked up and tried to start feeding, she recalls. - At that moment some women entered the door and demanded that I write an explanatory note. After that, they reported that they would not return my son to me again. ”

In maternity hospital No. 9 of the Moscow region of St. Petersburg, where Ludmila gave birth, they did not comment on the situation.

Fight for son

Meanwhile, almost immediately after the child’s withdrawal, the guardianship authorities filed a lawsuit in the Moscow District Court of St. Petersburg with a request to deprive citizen Lyudmila P. of parental rights. In addition, after the removal of the baby from an HIV-infected woman in the Ministry of Internal Affairs of Russia in the Moscow region of St. Petersburg, a criminal case was initiated against her under part 1 of article 122 of the Criminal Code of the Russian Federation (HIV infection). The investigation is ongoing, the police are not commenting on the progress of the investigation.

Lyudmila and her common-law spouse, also with HIV-positive status, decided to return her son. On July 11, the couple entered into an official marriage and filed a lawsuit in the Moscow District Court for the restoration of paternity and the transfer of a child to a father.

During court hearings on the transfer of the child to Lyudmila’s husband, guardianship representatives insisted that he undergo a genetic examination to establish paternity, and stated that the family was socially dangerous and could infect the child.

“At the paternity meeting, we tried to prove that the father did not do anything wrong with the child. The judge was also on our side. But custody believed that we, as HIV-infected people, one way or another infect a child, we will not treat him. Suddenly the child will die. They called us a socially dangerous family, ”recalls Lyudmila P.

Lyudmila and her husband provided the court with documents confirming that they started taking ARV therapy and were registered at the AIDS Center. On September 13, the Moscow District Court of St. Petersburg decided to transfer the child to his father, and on September 16, the parents took the boy from the orphanage.

“Of course, it was not without problems - in the child’s house they asked for a press about the entry into force of the decision. It was evident that they did not want to give the child up, but we threatened them with responsibility for the non-enforcement of the court decision, ”the woman shared her impressions.

However, Lyudmila’s struggle did not end there. On November 11, a hearing is scheduled to deprive a woman of her parental rights. In addition, a criminal investigation under Art. 122 of the Criminal Code.

“When my client testified, documents were added to the criminal case file that she had changed her attitude to her own health and the health of her child,” says Olga Krivonos, lawyer of Lyudmila, RT. “Lyudmila admitted that she was wrong in not going to the AIDS Center, but this does not mean that she intentionally wanted to harm the baby by breastfeeding. Her inaction does not amount to her desire to infect her baby with HIV. ”
