  • Judicial: The National Court reviews TV3 contracts in the 'case 3%'

Key evidence in the open case at the National Court for the alleged irregular financing of Democratic Convergence of Catalonia, known as case 3%. The Prosecutor's Office analyzes a recording of October 2011 provided by businessman Juan Manuel Parra in which his conversation with Germà Gordó, then Secretary of the Government and strong man of then President Artur Mas, is heard, in which he presumably specifies the way to award competitions public to companies related to the party.

«Now, when you go to the contests come see me. When you introduce yourself, I, I am not following them, I am not following them, and the contests that are there ... of that of the departments, I do not follow one. I do not follow them. But I told you "every time you introduce yourself to something, you come to see me and I will speak with the corresponding general secretary, with the corresponding department," Gordó tells Parra.

The businessman went to CDC to demand payment of part of the 750,000 euros that the party owed him for the audiovisual services made with his company Hispart in the 2010 election campaign after which Mas became president of the Generalitat. As stated before the judge, Parra said it was Gordó himself who told him that he would collect that money from ridding false invoices to the producer Triacom, who worked for TV3, but that the payments were delayed more than a year.

That is why the businessman came to talk to Gordó and recorded the conversation because "money was requested and I did not want to be paid." In the audio provided to the court the then secretary of the Government and subsequent counselor of Justice reminds Parra that in a previous meeting he had already told him that, in case of winning the elections “we will try to help you, not only from the City Council, of the Generalitat , of the Diputación »of Barcelona.

In this sense, Gordó remarked that these awards were supposedly for "when you presented yourself to things of the Generalitat" and opens the door to possible concessions in the City Council of Barcelona since at that time governed CDC. In the case of 3%, alleged irregularities are investigated in the concession of public works of the Generalitat and of some consistories, including that of Barcelona, in which Convergència ruled, in exchange for covert donations through the foundations of the party.

Even Gordó explains at one point in the conversation that «you know the only thing I do follow and this man knows it and this one too? The subject of the works, I all that are not works, I am not. And on the subject of the works I am able to give explanations to Mr. Viloca », treasurer of CDC at that time and also investigated in this procedure. "Everything that is not works, I do not even look at it, because every day the strip of things come out in the Official Gazette of the Generalitat, such as supplies or cleaning, and I am not on top," is heard in the audio.

In the meeting, the businessman only explains that a possible award of the Generalitat had been issued related to a contest for audiovisual acts of the Palau de la Generalitat and that he had talked about it with Francesc Homs, then a spokesman for the Government, and with another party directive . However, he finally decided not to run for the contest and to take the company that had won other concessions since the time of the tripartite "for not raising the hare." Despite this, Gordó allegedly urges him to communicate from now on the awards he is interested in since “I am not on top of what is being given, above why, among other things, because I do not manage any budget and I stayed with you , you go introducing yourself and come to ask me.

In this recording, Gordó also tells the businessman to go to the Institut Català de Finances (ICF) to obtain a loan since he was part of the board and "I have something to say when the credits are given or denied." “It is a 100% ours institution, which means that I am on the board and I have a certain weight. The secretary of the Government is not the president, nor the CEO, but I assure you that after the president and the CEO, the person who has the most weight on the board is me, more than the General Secretary of Economy itself, at the ICF ».

In this judicial procedure there is also a brief submitted a few weeks ago by Gordó's lawyer, Cristóbal Martell, in which the former counselor says that he “does not remember being part of a meeting” as described by the businessman in his statement and contributed in the audio, besides remembering that in their “judicially intervened” agendas they do not reflect this meeting. Gordó also "denies having arbitrated a circuit so that a third party will incur expenses for provider services."

Gordó acknowledged to the businessman that on the subject of TV3 contracts that is "the most important, nothing has been done, because, among other things, after a year, we continue to not control TV3", referring to the directors of the public broadcaster and the time that has elapsed since CDC won the elections. The businessman claimed a debt of about three million euros to the party counting campaign and electoral campaign acts that were discussed by Gordó and the other CDC executives present. The then secretary of the Government assures that, in a meeting before the elections in which the former CDC Communication Secretary David Madí was also there, they would only pay more than one million euros for these works, supposedly through Triacom, although He committed with Parra to, once the elections were won, "I will help to give you all the work possible."
