The Supreme Court, in accepting the appeal of the attorney general, had ordered a new trial deeming the crime of stalking not absorbed in that of homicide, as instead sustained in the first judgment of appeal ended with a sentence to 30 years of imprisonment.

Paduano was thus convicted of two separate crimes, multi-off homicide and stalking, accepting the decision of the judges of the Supreme Court who underlined the reasons for which the sentence for which the crime of aggravated murder absorbs the crime of persecuting acts is incorrect ".
