It was a Thursday at the end of October last year that the plaintiff would drive three trucks lined up on the highway. When he went into the overtaking file, "a car came up behind him, who was lying very close to his car and who was blinking with the lights. The landlord then put his foot lightly on the brake to indicate that the car behind was too close. After the detour was done, he went back into the right lane. Then the following car, driven by the 43-year-old, began to punch him against the roadside. At some point, it narrowed and the plaintiff got a dent in the door.

Throttle and death threat

In the end, the car driven by the 43-year-old swerved in front of the landlord and forced him to stop on the highway. According to the plaintiff, the 43-year-old jumped out and opened his car door and took strangles and pronounced death threats against him and his family.

The 43-year-old was then interrupted by a woman who was in the car and then hit his "car door so hard that the door's interior released".

Worried about family safety

The 43-year-old's version of the event is a completely different one. He says the landowner was driving at too low a speed when overtaking the trucks and thus appeared dangerous on the highway.

The 43-year-old had his family in the car and was worried about their safety. He says he in no way managed to stop the car owner. Neither was talk of strangulation, but the 43-year-old "put his hands in the car to grab XXX and shake him." However, he admits to saying ugly words, "which he apologizes for".

Conditional and community service

A witness who also traveled on the highway and saw drama, however, supports the plaintiff's version of the incident in general. The 43-year-old is sentenced by the district court to conditional sentence with 75 hours of community service. "If imprisonment had instead been chosen as a penalty, imprisonment would have been sentenced to two months," the district court writes in the judgment.
