According to ONF experts, today the law on the protection of the rights of individuals in debt collection (limiting the number of personal meetings and the number of calls, the ban on disclosing information about the debtor and other measures) applies only to collectors.

Moreover, according to ONF, banks often flagrantly violate the rules on the protection of the rights of individuals when collecting overdue debts. According to the organization, such complaints have repeatedly come from Russians from different regions of the country.

In the case of adoption of the developed amendments, officials acting on behalf of banks that violate the rules for interacting with debtors may be fined up to 100 thousand rubles or disqualified for up to one year. At the same time, banks themselves may be fined up to 200 thousand rubles.

“We do not see any justifiable reason for maintaining such a concession for banks in the CAO. Moreover, now we are witnessing an unacceptable contradiction in the legislation when the law on the protection of citizens' rights when collecting debts is valid for almost all creditors, including banks, and the article of the Administrative Code establishing liability for its violation does not apply to banks. This situation, which is incorrect from a formal point of view, results in impunity for banks, which sometimes violate the rights of debtors as often and unceremoniously as ordinary collectors, ”said Natalya Kostenko, member of the ONF central headquarters, coordinator of legislative initiatives of the People’s Front in the State Duma.

According to Yuri Tverdokhleb, associate professor at the Department of Regulation of Financial Institutions of the Faculty of Finance and Banking, RANEPA, this initiative is absolutely justified.

“The fact that today banks can bother customers with impunity beyond reasonable limits with impunity is unacceptable. The dissatisfaction of banks in this situation can be regarded as a desire to receive some privileges in this sensitive area of ​​activity. Their dissatisfaction should not be taken into account. The fact that until now there was a gap in the legislation, which allowed banks to sometimes abuse their authority in collecting debts, should be corrected, and uniform rules should be for everyone, ”the expert said.

Earlier, Russian leader Vladimir Putin signed a law prohibiting the transfer to collectors of public debts for the provision of housing services.
