The lawsuit has been filed with a California court, where the notifier requests that it be granted class action status.

The problems appear to have arisen in May, when Tesla provided an update since a Model S caught fire in Hong Kong. Tesla stated that it was reviewing the charge and temperature settings, with the stated goal of better protecting the battery and increasing its service life.

Lower battery capacity

Since then, the issue of poorer battery capacity has been a hot issue on online forums, with some owners claiming to have lost as much as 64 kilometers in range per charge.

"A very small proportion of owners of older Model S and Model X vehicles may have noticed a slight reduction in range when they are charged to a maximum charge state after a software update designed to improve battery life," Tesla comments in a comment.

Tesla began last week to remotely update cars in order to fix the problem, according to the company.
