The Basmanny District Court sent Sergei Fomin, the person involved in the criminal case of the riots in Moscow on July 27, to the pre-trial detention center for two months. The investigator and the prosecutor insisted on the detention of Fomin - they emphasized that the accused could try to hide, destroy evidence or “reach agreements” with accomplices.

In turn, Fomin and his lawyer Alexey Veselov asked Judge Valentin Levashov to pay attention to the fact that the accused voluntarily appeared in law enforcement when he found out that he was on the federal wanted list in the riot case.

“I was on vacation on the 31st of July (July - RT ) and found out from the network that I was wanted. I myself returned, and returned with my lawyer. Because I'm not to blame. Since I myself have returned, I believe that this is sufficient reason to understand that I will not run away. I ask for a house arrest, ”Fomin said at a meeting on the adoption of a preventive measure.

Nevertheless, the judge decided to satisfy the requests of the prosecutor and investigator and imposed a measure of restraint in the form of detention on the accused. Fomin’s lawyer, Alexei Veselov, told RT that the defense side intends to appeal the decision to elect this preventive measure.

“Of course, we hoped that another preventive measure would be chosen, but on the whole we were ready for this. We will appeal this decision. The grounds for choosing a preventive measure have not been proven, ”Veselov said.

Rioting

According to the investigation, on July 27, 36-year-old Sergey Fomin participated in an unauthorized rally in the center of Moscow. The network got videos that capture how a man actively interacts with other protesters.

On July 31, law enforcement officers came to Fomin’s home and his parents with searches, but, after interrogation in the SK, they released him. In a conversation with investigators, Fomin denied that he had organized the actions of participants in the unauthorized rally on July 27.

Nevertheless, on August 5, the Investigative Committee put Fomin on the wanted list, and on August 8, a man, accompanied by his mother and lawyer, voluntarily appeared in the investigating authorities. Lawyer Alexei Veselov explained to RT that the decision of his client to come to law enforcement on his own was not a “confession” - according to him, Fomin, having learned that he was wanted, just wanted to figure out the situation.

On August 8, Fomin was detained in accordance with Art. 91 of the Code of Criminal Procedure of Russia, he was charged under part 2 of article 212 of the Criminal Code ("riots"). According to her, a man can face from three to eight years in prison. At a meeting of the Basmanny District Court, Fomin refused to plead guilty.

The child at the rally

On the eve of the meeting to elect a preventive measure, Sergei Fomin was also questioned as a witness in the case of the spouses Dmitry and Olga Prokazovs, who appeared at an unauthorized rally on July 27 with a one-year-old child. Earlier, a video appeared on the network showing how parents pass the boy to Fomin before he left the rally, ostensibly so that the man could pass through the cordon unhindered.

As a result, two criminal cases under Art. 125 (“Abandonment in danger”) and 156 (“non-fulfillment of obligations to raise a minor”) of the Criminal Code of the Russian Federation. The Moscow prosecutor’s office considered that the parents put the obviously helpless son in danger when they transferred him to Fomin, thereby exploiting the child. In this regard, the supervisory authority sent a statement of claim to the Perovskiy court of Moscow to deprive Leprosy parental rights.

However, on August 6, after the interrogation of the Prokazovs in the UK, their lawyer Maxim Pashkov said that the investigators have no complaints against spouses. According to him, the child’s parents explained that Fomin is their godfather, and is also a cousin of Olga Prokazova. On the day of the unauthorized rally, the family, according to the spouses, simply walked around the center of Moscow without taking part in the rally. Then they allegedly met their relative Sergei Fomin and gave him a nephew to carry.

On August 9, Sergey Fomin was also questioned as a witness in criminal cases against Dmitry and Olga Prokazov. According to TASS, Fomin confirmed the version of the spouses. An interlocutor of the agency, familiar with the situation, said that the issue of terminating criminal cases against Prokazovs was now being decided.

New defendants

On August 9, in the framework of the criminal case under investigation by the Main Investigation Directorate of the Investigative Committee of Russia on mass riots and the use of violence against representatives of law enforcement agencies (Article 212 and Article 318 of the Criminal Code of the Russian Federation), two more participants in the disorders were detained - Aidar Gubaidulin, born in 1993 and Danila Beglets, born in 1992 . Both detainees have already been formally charged under Part 2 of Art. 212 of the Criminal Code. As in the case of Fomin, the investigation requested a measure of restraint for the accused in the form of detention.

At the moment, a total of 12 persons are held in the joint criminal case of the July 27 riots. According to the Investigative Committee, the role of each of them in illegal actions is now being established.

On July 8, Sergey Fomin called Alexey Navalny and FBK lawyer Lyubov Sobol “personally responsible” for the arrests of participants in an unauthorized rally on July 27. According to the man, they called on Muscovites to participate in the rally, but did not explain how to behave. Earlier, Fomin himself collected signatures for nominating Sable as a candidate in the elections to the Moscow City Duma.
