The Barcelona City Council has sent a report from the Office for Non-Discrimination (OND) to the municipal centers with a swimming pool that reminds that the 'topless' must be allowed in all its spaces, because not doing so would represent a "discriminatory" practice, when setting dress standards based on gender.

Asked in statements to the media on Tuesday, Deputy Mayor Janet Sanz stressed that this practice has never been prohibited in municipal swimming pools and what the OND has done has been to remind the centers.

The goal is that "all women who want to do 'topless' can do it" normally in municipal centers, whether public or private, said Sanz, who stressed that the municipal government wants all women to Feel free in these centers.

The Mugrons Lliures entity presented a complaint to the OND, which argued that the regulations that regulate clothing based on gender are discriminatory, so it recommends that municipal centers with swimming pools withdraw any regulations that prohibit the 'topless' in their spaces .

Mugrons Lliures turned to the OND - after a user complained that she had been urged not to do 'topless' - due to the lack of unity of criteria in sports centers, since the 'topless' is usually allowed in the Pool area but some centers had put restrictions on bathing or in specific areas of the installation, by internal regulations.

Municipal sources have stressed that there is currently no specific regulation on the clothing of users of public swimming pools , so the OND has made a report that defends the principle of equality and non-discrimination, so it must be guaranteed that the 'topless' is not prohibited.

Thus, it has been recommended to apply this criterion to all municipal sports centers with a public use pool, to which this report has been sent, through the Institut Barcelona Esports, responsible for the Esportius Municipals Centers (CEM).

Sanctions if required

The same sources have explained that it is a recommendation and that no center has objected to it, but that if one fails to comply with it, sanctions could be applied because it is a discriminatory practice.

Sanz has stressed that the objective is not to sanction and has said that it has been possible to prohibit the practice due to ignorance of the norm, so they have sent this recommendation to remember that the 'topless' must be allowed.

This recommendation, based on a legal report, makes no distinction about indoor or outdoor swimming pools, according to the same sources, so that the 'topless' is allowed both in some facilities and in the others.
