The Court of Justice of the Republic has opened an investigation into former Budget Minister Eric Woerth that she suspects of granting a huge tax rebate to Bernard Tapie.

The Court of Justice of the Republic (CJR) opened a criminal investigation against Eric Woerth for "concussion", that is to say the granting of an undue advantage in the context of the controversial arbitration on the conflict between Bernard Tapie at Crédit Lyonnais on the resale of Adidas. The procedure was launched about a month ago, a few weeks before the release of the businessman on Tuesday in his criminal trial on suspicion of "scam" under this agreement.

The facts go back to 2008, when Bernard Tapie gets 403 million euros from the arbitral tribunal. Bernard Tapie wants then that this sum is taxed by the fisc as a surplus-value to less than 2%. But the public finances, they, rather suggest to apply the corporate tax which amounts to 33%.

After a long standoff between the businessman and the tax authorities, Eric Woerth finally decided in 2009 and, without warning the tax authorities, decided to grant a large tax rebate to Bernard Tapie. Instead of the 72 million euros in taxes he should have paid, he will finally have to pay only 11 million. A fraudulent tax exemption that oscillates around 61 million euros.
