Danzhou, June 6 (Zhongxin Net) -- A father and son in Baisha Li Autonomous County, Hainan Province, Fu Moujia and Fu Mouyi, were recently sentenced by the Hainan Provincial No. 6 Intermediate People's Court to six months' imprisonment and one year's probation for illegal hunting for catching wild boars and macaques in Hainan Tropical Rainforest National Park; The sentence was 6 months' imprisonment, suspended for 1 year and 8 months. The two said they accepted the verdict and would not appeal.

On December 2020, 12, Fu Moujia purchased 30 spring sockets on the grounds of preventing wild boars from damaging their rubber trees. Without the approval of the wildlife administrative department and without obtaining the "Hunting License", Fu Moujia knew that his rubber plantation was located in the jurisdiction of the Lugeling Branch of the Hainan Tropical Rainforest National Park Administration and hunting was prohibited in the area, and still placed four of the spring clamps around the rubber garden without authorization to illegally hunt wild animals, but did not hunt wild animals.

In early January 2021, Fu Mouyi believed that a wild boar had stolen jackfruit planted in his own rubber plantation, and without the approval of the wildlife administrative department and without obtaining a "hunting license", he knew that the village and his rubber garden were located within the jurisdiction of the Lugeling Branch of the Hainan Tropical Rainforest National Park Administration and hunting was prohibited in the area, but still used wire ropes to set up hunting traps in his rubber plantation to illegally hunt wild animals, and hunted a wild boar to take home and slaughter and eat. In late April, Fu bought iron clips from a hardware store in Baisha County, placed them in the mountains and forests opposite the village to hunt wild animals, hunted a monkey and took it home to raise.

It was identified that the monkey hunted by Fu Mouyi was a macaque of the primate monkey family, which was a national Class II. protected animal and was listed in Appendix II of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). Wild boar is listed in the "List of Terrestrial Wild Animals Protected by the State as Beneficial or with Important Economic and Scientific Research Value", which is a national "three haves" protected animal.

The place where Fu Moujia placed the spring sleeve clamp, and the place where Fu MouB set up the hunting sleeve and placed the iron clamp are all located in the administrative area of Baisha County, the area is a game reserve, and the whole year is the hunting period, and the spring sleeve, hunting sleeve and iron clamp are all hunting tools. From August to September 2021, Fu Moujia and Fu MouB took the initiative to surrender to the Lugeling Protection District Bureau of the Forest Public Security Bureau of the Hainan Provincial Public Security Department. The macaques hunted by Fu were released by the Lugeling Branch of the Hainan Rainforest National Park Administration to the surrounding primeval forest.

After hearing, the Hainan Second Intermediate Court held that Fu MouB and Fu Moujia used prohibited methods (hunting clips) to hunt in the game reserve and during the hunting ban, among which Fu Mouyi hunted a macaque monkey protected by the national Class II. protected animal and listed a wild boar protected by the State in the "List of Terrestrial Wild Animals Protected by the State as Beneficial or of Important Economic and Scientific Research Value", and both of their acts violated the second paragraph of Article 341 of the Criminal Law of the People's Republic of China, constituting the crime of illegal hunting and should be punished according to law. In view of the fact that Fu MouB and Fu Moujia voluntarily surrendered after committing a crime and truthfully confessed the facts of their crime, they can be recognized as turning themselves in, and voluntarily admitting guilt and accepting punishment, and the punishment can be reduced according to law, and the suspended sentences of the two of them can be pronounced without major adverse effects on the community where they live, and the Hainan Second Intermediate Court made the above judgment.
