Under the strict "travel restriction order", many online game platform service providers strictly limit the time for providing online game services to minors, and require real-name registration, and some enterprises have set up multiple "face verification" checkpoints to prevent minors from becoming addicted to the Internet.

The setting of the platform has saved parents a lot of worry, but there are still criminals who seize the psychology of minors who want to play online games and rent out accounts that can play online games without barriers for profit.

A parent in Huqiu District, Suzhou City, Jiangsu Province, found that his son had no intention of studying and addicted to games, and after checking his child's mobile phone, he found that his child had spent more than 2000,<> yuan renting an online game account in less than a month.

Parents promptly reflected the collected order information, payment records, chat records and other evidence materials to the procuratorate, hoping to dig up the hidden secrets behind the purchase and sale of game accounts.

According to the parents' complaints, the procuratorate found that Liu Cheng (pseudonym) was suspected of renting game accounts to minors, and after further inquiring Liu Cheng about the relevant situation, the procuratorate believed that Liu Cheng was suspected of the crime of infringing on citizens' personal information, so it transferred the clues to the public security organs.

Liu Cheng is a construction site data clerk who likes to buy designer shoes and often feels strapped for cash. At the beginning of 2021, Liu Cheng saw an advertisement in a QQ group, claiming that he could crack face recognition.

Liu Cheng felt that it was profitable, and immediately sent a private message to group friends to obtain "cheats". It turned out that the goods sold by the other party's "advertising" turned out to be "materials", that is, a complete set of personal information containing names, ID numbers and face dynamic videos, and after purchasing the information, the face recognition authentication of some platforms can be easily unlocked through special operations.

Liu Cheng, who has multiple game groups, thought of the strict restrictions on minors on game platforms and began to ponder the "business experience".

The cracking process of the real-name authentication system of the game platform confessed by Liu Cheng is: he bought a lot of high-level game accounts, after purchasing "materials", Shangjia helped him operate and change bindings, and then needed face authentication, and they also helped operate through face recognition, which is called "over face" in the industry.

Considering the needs of players for high-level accounts, Liu Cheng did not directly register the purchased personal information as a game account, but made full use of the loopholes in the real-name authentication system of some game platforms.

In multiple games, game accounts bound to QQ numbers and verified by real-name can directly use minors' information to replace identity information. In this way, Liu Cheng purchased a batch of minors' personal information and realized the control of multiple game accounts by changing bindings.

However, minors' game accounts are greatly limited in terms of game duration, permissions, and consumption quotas. To this end, Liu Cheng purchased a large amount of personal information that would become an adult in a day or two.

In this way, the game account controlled by him will no longer be regulated by the anti-addiction system after replacing the registration information for a day or two, and will become an adult account that can play online games at any time, and then can be rented out to minors smoothly.

In June 2021, he specially purchased a mobile phone for "over the face" and began to operate it himself.

The mobile phone purchased by Liu Cheng is preset with certain programs, just complete simple operations such as saving data according to the established path, and when logging in to the game authentication interface, the video saved in the mobile phone will automatically appear in the face recognition box for authentication.

"Most of the time the certification is very smooth, and sometimes there will be a situation where it cannot be identified, I will specifically find someone who 'retouches', and usually they can pass the certification after 'refinement'." Liu Cheng said frankly that "passing the face" is not a difficult task for "experts".

Following this methodology, he had dozens of different accounts for each of the 8 most popular games in a short period of time.

Not only selling game accounts, but also remotely removing the "face recognition" pop-up window verification, relying on such a marketing road, Liu Cheng has many "customers".

"The price of 'materials' ranges from a dozen yuan to seventy or eighty yuan, the average price of one group is about 30 yuan, and the income from renting game accounts ranges from 10 yuan to 20 yuan per hour per account, and it can be returned in one or two hours." Liu Cheng said.

For more than half a year, he earned more than 1,4 yuan by renting out these game accounts registered with other people's information.

On December 2022, 12, the case was transferred to the Suzhou Huqiu District People's Procuratorate for handling, and after reviewing the case, the prosecutor concluded that the facial information had a high degree of personal biometric characteristics and belonged to sensitive personal information, and Liu Cheng's behavior had constituted the crime of infringing on citizens' personal information.

At the same time, Liu Cheng circumvented the national policy of requiring real-name authentication for online games, interfered with the process of face recognition authentication, violated the privacy and property rights of an unspecified majority of minors, and caused damage to the public interest.

Subsequently, the procurator conducted a public hearing and deliberation on whether Liu Cheng's rental game account was a legal operation, and issued procuratorial recommendations or legal risk reminder letters to relevant online game platforms, mobile phone manufacturers specially used for "face-to-face" and online game account rental platforms, transferring criminal clues of persons who sold personal information to Liu Cheng to the public security organs and urging timely verification.

At the same time, Liu Cheng was required to return more than 1,4 yuan of illegal gains to compensate the relevant victims, permanently delete the information involved in the case stored in his mobile phone and computer, publicly apologize in the national media, and compensate more than 1,4 yuan for public welfare losses.

In order to ensure that the public welfare compensation funds are earmarked, the procuratorate also cooperated with the Tiger Hill District Charity Federation to set up a special fund for "Unloved Bloom" to receive public welfare compensation funds, and use the compensation funds for public welfare undertakings such as the protection of minors' personal information.

In addition, the procuratorate requires Liu Cheng to participate in warning education, public interest publicity, volunteer services, etc. related to personal information protection once a quarter during the probation period, so as to further repair and repair the damage caused to the public interest by the illegal conduct, and the procuratorate will supervise this.

On February 2 this year, after a trial, the Huqiu District People's Court adopted all the litigation claims put forward by the procuratorate and made a judgment, which has now taken effect, Liu Cheng has paid the compensation to the "Unloved Bloom" special fund, publicly issued a statement to apologize, and completed the first volunteer service to repair public welfare damage.

"The protection of minors' personal information cannot be ignored, and the Internet is the hardest hit area for minors' personal information leakage. In this regard, procuratorial organs shall always crack down strictly in accordance with law, and on the basis of pursuing the criminal responsibility of relevant personnel, strengthen deterrence and governance through methods such as public interest litigation, procuratorial suggestions, and public hearings, and promote coordinated governance of the protection of minors' personal information. The relevant person in charge of the Huqiu District People's Procuratorate of Suzhou City said.
