Nanning, March 3 (Wei Xiaoting, Huang Yingying, Xian Feng) China's Ministry of Agriculture and Rural Affairs recently released the "China Fishery Administration Bright Sword 29" top ten typical law enforcement cases, and "Baise City Luo Moumou released alien species without approval" was selected among them. This case is the first case of unauthorized release of alien species in China, which is of great significance for further standardizing the release and breeding behavior, improving the public's awareness of the prevention of invasive alien species, and guiding the whole society to jointly protect the ecological environment of waters.

According to the Guangxi Department of Agriculture and Rural Affairs, on September 2022, 9, the Baise Agricultural Comprehensive Administrative Law Enforcement Detachment received a report from the public that someone was suspected of releasing an alien species leopard winged catfish (commonly known as a scavenger) in the waters near the wharf of Yongle Town of the Chengbihe Reservoir in Baise City on the same day. Accompanying personnel took photos and videos of the scene and uploaded them to the short video platform, which aroused great attention from public opinion.

After receiving the report, the law enforcement personnel of the detachment quickly rushed to the scene for an inquest and extracted relevant audio and video evidence in accordance with the law. After investigation, the party Luo Moumou carried out the "release" activity in the Chengbi River Reservoir without approval for the purpose of "praying for blessings", and the animals involved in the case were identified as an alien species leopard striped winged catfish.

In the process of handling the case, the Guangxi Department of Agriculture, Agriculture and Rural Affairs Bureau of Comprehensive Administrative Law Enforcement of Agriculture promptly intervened, formed an expert group to guide the whole process, checked the case handling procedures, investigation and evidence collection, case characterization, and judicial connection of criminal law, coordinated the convening of special seminars, and consulted with procuratorial organs and public security organs, and finally accurately applied relevant legal provisions to effectively punish the parties.

The Baise Agricultural Comprehensive Administrative Law Enforcement Detachment found that Luo Moumou had violated the relevant provisions of the Biosecurity Law of the People's Republic of China by releasing alien species without approval, ordered him to capture the released alien species within a time limit, and imposed a fine of 2,8 yuan.

The comprehensive administrative law enforcement department of agriculture reminds: scavenger, scientific name leopard stripe winged catfish, native to South America, introduced to China in 1980, now widely distributed in Guangdong, Guangxi, Hubei and other places. Scavengers have few natural predators, strong fecundity, and large swallowing of fish eggs and fry, which seriously threatens the breeding and growth of native fish. In August 2014, the former Ministry of Environmental Protection and the Chinese Academy of Sciences jointly issued the List of Invasive Alien Species in China (Third Batch), listing them as invasive alien species. According to the second paragraph of Article 8 of the "Biosecurity Law of the People's Republic of China", "where the provisions of this Law are violated by releasing or discarding alien species without approval, the relevant departments of people's governments at the county level or above shall, on the basis of their duties and division of labor, order the capture or retrieval of the released or discarded alien species within a time limit, and give a fine of between <>,<> and <>,<> RMB."
