Vulgar stationery and toys are sold both online and offline

Experts: Suspected of violating the law, if the merchant sells knowingly, he must be punished more severely

In the past few days, the topic of "a 10-year-old girl bought a sexually suggestive keychain in a stationery store" has continued to spark heated discussions.

According to the girl's parents, these keychains were printed with sexually suggestive pictures and texts, such as "Kneeling for a mistress", "Chunxin rippling", "If one day I become a pervert, please don't forget my innocence", "Catch up with girls"... After that , the local market supervision department intervened to deal with it, and the stationery store stopped selling and destroyed the keychain of the same style.

Is there still sales of vulgar stationery toys with sexual innuendo?

What adverse effects might these stationery toys have on the growth of minors?

With these questions, the reporter launched a survey interview.

  □ Our newspaper intern Guan Chuyu

"You are my boyfriend, what's wrong with playing with the plane, is it too much?"

"I'm heavy? Practice, Kidney Deficiency Boy."

"You don't sleep with me, what time do you care about me?"

  ...

This is a reporter from the "Rule of Law Daily" recently visited stationery stores near many primary and secondary schools in Yangxi County, Guangdong Province, and saw some stationery stores selling a copy called "Sanrio Sand Sculpture Emoji Stickers".

The reporter's investigation and interview found that this kind of vulgar stationery toys containing sexual hints are sold both online and offline.

Many interviewed experts pointed out that the production and sale of stationery and toys containing sexual cues is suspected of violating the law on the protection of minors, and in serious cases may violate the criminal law.

If a merchant knowingly sells a large number of stationery toys with obscene and pornographic information, the penalty must be increased.

sticker copy foul language

The figure is blatant and makes people blush

The reporter came to a primary school stationery store in Yangxi County, Guangdong Province and saw that the merchant had placed many small toys in the most conspicuous booth outside the door, including small playing cards, blind box cards, stickers, small board games, etc.

After school at noon, the stationery store ushered in a large number of small customers. These small toys are very popular among students, and the prices are mostly between 1 yuan and 5 yuan.

Among them, the blind box card is the most popular, 1 yuan per pack, and there are two animation character cards inside.

The reporter noticed that some animation characters in blind box cards are more sexy and revealing.

The owner of the stationery store told the reporter: "These blind boxes of cards are very popular, and elementary school students like them very much. My daughter also buys them often. I heard that there are hidden cards that can be removed, but I see that the ones she removes are almost the same every time."

It is worth noting that during the visit, the reporter found that many stationery stores near primary and secondary schools were selling a sticker called "Sanrio Sand Sculpture Emoji Stickers", and the animation characters on the stickers contained many sexual hints.

There are also some small stickers with more "violent" copywriting, such as "My father just kicked when he flew up", "It's outrageous, my mother just punched me directly", etc.

At the same time, the reporter found in a stationery store near a middle school in Yangxi County that there were a lot of stickers on the stalls in front of the door, and the copywriting was full of obscene language and violent content.

"Why are there so many foul language on these stickers?" Facing the reporter's question, the owner of the stationery store seemed a little surprised, "These are all new stickers, and I didn't look carefully when I bought them."

In a stationery store in Jizhou District, Tianjin, there is an endless stream of people who come to the store to choose stationery and toys during holidays.

The reporter observed that on a shelf in a stationery store, most of the senior students coming and going would stop here. It turned out that the shelf was full of various animation figures, with realistic workmanship and many wearing revealing clothes.

"It's too explicit, such a toy makes adults blush." A parent who came to buy stationery for his children muttered.

After a few days of offline visits, the reporter found that most of the stationery toys sold in stationery stores are relatively normal, and stationery toys that are not suitable for children such as sexual hints account for only a small part.

"Keychain" available online

Vulgar toy Internet explosion

As for the keychain involved in the news of "a 10-year-old girl bought a sexually suggestive keychain in a stationery store", the reporter found that an e-commerce platform is still selling the keychain, and some merchants specifically marked the keychain as "a hot spot in the school gate store". Pin Hanger Toy".

The reporter learned that these keychains are actually "flintstones thousands of times matches". "" Kneeling for a mistress" and so on.

The reporter consulted the online store merchants on the grounds of purchasing goods and setting up a stall.

The merchant told the reporter that this toy is the best-selling one in the store, and he also sells it offline at night markets.

When the reporter pointed out that "the copywriting of these keychains is too exaggerated", the merchant responded that some copywriting is indeed exaggerated, but there are always some students who like it.

The shop owner revealed that he set up a stall in the night market to sell the keychain at night, and the main consumer groups are primary school students and junior high school students.

The reporter also saw many buyers commenting in the comment area of the toy store: This toy is very popular, and children like it very much.

The "Sanrio Sand Sculpture Emoji Stickers" that the reporter saw online in a furniture store are also sold on major e-commerce platforms, and some merchants have labeled them as "hot style" and "hot sale around campus".

Its product details page states that the applicable age group is between 8 and 14 years old.

In addition, the reporter found that the copywriting of some spoof emoticons on e-commerce platforms is even more filthy, using homophonic stalks, such as replacing "color" with "astringent", containing a lot of sexually suggestive content, and some monthly sales are as high as "100,000+".

Animation figures have always been very popular among students of the second dimension. However, when a reporter searched for "figures" on an e-commerce platform, they found that many figures of female images were not only explicit, but also had very enchanting and exaggerated postures.

Some merchants even directly put mosaics on the private parts of these figures, stating that "too realistic to display".

One of the shops sells the "Green Ghost Girl" figure that is almost naked. There are countless similar animation figures. Although some figures have clothes, some merchants specifically note that they can be taken off.

For some figures with exaggerated and very explicit poses, the merchants noted on the details page "private delivery, no sensitive information on the face sheet, and the courier brother doesn't know what it is".

In December 2021, a reporter from our newspaper conducted an investigative report on the sale of sexually suggestive spoof candies and toys such as "condoms" and "tintin pillows" by some merchants on e-commerce platforms.

At present, the reporter found that most of the candies and dolls containing sexual cues have been taken off the shelves on e-commerce platforms.

However, some spoof wet wipes whose outer packaging resembles "family planning supplies" are still on sale, and the copywriting on them is unsightly.

Vulgar toys are very harmful

Crack down on deliberate selling

Chu Zhaohui, a researcher at the Chinese Academy of Educational Sciences, believes that the reason why these stationery toys with vulgar copywriting such as sexual hints emerge in endlessly is mainly because the merchants are profitable. They take advantage of minors who are immature, curious about sex, and difficult to correctly judge values. The characteristics of the film are marketed in the form of soft pornography + stationery toys for profit.

"Actually, in terms of quality alone, this kind of stationery and toys are substandard products produced by small workshops. The market supervision department should increase law enforcement supervision and punishment to eliminate such problems as much as possible." Chu Zhaohui said.

Is it illegal to produce and sell these sexually suggestive stationery toys?

Wu Xumeng, a lawyer at Guizhou Xinrui Linyang Law Firm, analyzed that the production and sales of these stationery and toys containing sexual cues violated the law on the protection of minors, and serious cases may violate the criminal law.

The Law on the Protection of Minors stipulates that the dissemination of books and articles containing obscene and pornographic information is prohibited, and the copywriting on the keychain involved is pornographic and obscene for teenagers.

"For the dissemination of obscene and pornographic materials, warnings will be given for minor cases, and a fine of less than 100,000 yuan may be imposed for severe cases, and the business license may be revoked for severe cases." Wu Xumeng said that if these stationery toys are relatively large and spread widely, they are suspected of violating the criminal law. The crime of disseminating obscene materials for profit and disseminating pornographic materials may be sentenced to a fixed-term imprisonment of not more than three years, public surveillance, criminal detention, and a fine.

At the same time, from a certain point of view, such behavior also violated the Civil Code, violated the legitimate rights and interests of young people, and affected their physical and mental health.

"Of course, the subjective wishes of the merchants should also be considered. If the quantity is not large or there is no attention, you can educate them; if you know that there are obscene and pornographic information and sell a lot of them, you should be punished, and the punishment should be increased." Wu Xumeng said. .

Wu Xumeng reminded that if parents find that the stationery store sells stationery toys with sexual implications, they can complain to the local market supervision department or sue the court for rights protection, but they must keep the relevant products and sales receipts as evidence.

"Schools should strengthen publicity and education to make minors realize that these are bad things, and don't touch or buy them; parents should also strengthen their children's ability to distinguish, and don't buy them just because they think it's fun; businesses can't even sell these stationery on purpose. Toys are illegally making profits; the local market supervision department should strengthen inspection and supervision." Wu Xumeng said.

In Chu Zhaohui's view, standardized, active, and healthy sex education should be given to minors in a timely manner, and families, society, schools, and related manufacturers must all take responsibility and not pass on a distorted and vulgar sexual cognition to minors. adults.
