The organization recalls that a lottery tenth is a bearer document, that is, the prize is received by whoever has it in their possession.

For this reason, if the ticket is shared (that is, if participations are made), the depository of the same must photocopy it and give each participant a signed copy (with the name and ID of the depositary) indicating that the person play in that number, series, fraction and draw, a certain amount of euros.

However, currently you can also send a photo of the tenth by email or other means of instant messaging such as WhatsApp.

According to the OCU, this can be a test, "as long as" the data of the depositary, the participants and the participation of each one appear.

Likewise, it points out that

if you buy the tenth ticket online,

you have to make sure that it is done on an official page of an authorized lottery administration.

It can also be done directly on the State Lottery and Betting website;

In this case, an associated point of sale must be chosen, which can be any of the lottery administrations in Spain.

In this sense, the OCU indicates that when buying online

an electronic receipt of the tenths

purchased is received: this electronic document has the same legal validity as the tenth on paper and proves the ownership of the tenth.

The original tenths are deposited in the safe of the lottery administration.

In case of loss or theft of the tenth, it is essential to report it to the National Police or Civil Guard of the place where the event occurred.

The complaint must record as much information as possible and all the circumstances of the event, provide possible evidence _photos or photocopies of the tenth_, clearly identifying the document number, series and fraction.

In addition, the fact must be communicated in writing to the State Lotteries and Gambling agency.

With the complaint, payment can be stopped until the judge decides who the real owner is.

Collect Christmas lottery prizes

To collect a

prize of less than 2,000

euros, you can do so at any point of sale in the Lottery network.

If the winning ticket has been purchased online, the amount is automatically entered into the user account, which can later be transferred to the desired bank account.

From 2,000 euros, it is charged at one of the collaborating banking entities, whose list can be found on the State Lotteries and Gambling website.

OCU reminds that these banks will not be able to charge any commission, nor demand consideration.

Once this is done, the banks can credit the entire prize (after deducting the amount for which it is taxed) into the account of the person who already has an account with that bank and who will later distribute as agreed.

According to the organization, it is not convenient to collect the entire amount without first identifying the other participants, since when distributing it it may appear that the money is being donated, which would force the payment of donation tax.

In addition, it must be taken into account that the Treasury automatically withholds 20% of the part of the prize that exceeds the exempt minimum of 40,000 euros for each tenth, not for each person awarded.

That is, the tax is discounted and then the net amount is distributed among the participants.

The prize is not declared in the IRPF, the yields it generates, yes.

Finally, the OCU recalls that the right to collect the prizes from the Christmas raffle expires three months from the day after the raffle is held.
