More than two weeks have passed since the trial on July 22, and Zhao Yong is still waiting for the verdict.

  Zhao Yong is one of the parties involved in the "textbook-style Lao Lai" incident in Tangshan, Hebei.

In October 2015, his father was hit by a car driven by Huang Shufen while riding a bicycle across the road, and was diagnosed with severe head injury after being sent to the hospital.

Then Zhao Yong sued Huang Shufen for compensation, and the court ruled that the amount of compensation should be about 860,000 yuan.

  Because Huang Shufen did not pay the compensation within the stipulated time, Zhao Yong posted Huang Shufen's remarks on social media such as "I have a high income, I have to repay the loan", "(The court) sentenced to a few years, at least I don't have to pay back this amount of money." On the platform, "textbook-style Lao Lai" became a hot word and attracted attention.

  From entering the compulsory enforcement stage in 2017 to June 29 this year, the enforcement bureau of the court issued about 110,000 yuan of enforcement funds from Huang Shufen to Zhao Yong.

After his father died at the end of 2017, Zhao Yong insisted on pursuing compensation.

In order to get the remaining compensation, lawsuits have become part of his life.

  It has been seven years since the car accident and five years after the compensation judgment was handed down. Netizens familiar with Zhao Yong expressed emotion on social platforms that they left the campus to enter the society, bid farewell to being single, married and had children, and entered a new stage of life. Zhao Yong was still in the quagmire of lawsuits.

  "Textbook-style Lao Lai" incident

  Based on Zhao Yong's remarks and relevant media reports, on October 6, 2015, Huang Shufen, who had just obtained her driver's license for two months, was driving her daughter's car, and hit Zhao Moubin, who was riding a bicycle across the road, on Tangfeng Road, Tangshan City, causing injuries on the spot. 62-year-old Zhao Moubin suffered head injury.

The Tangshan traffic police later determined that Huang Shufen was in charge and Zhao Moubin was in charge.

  On June 8, 2017, the People's Court of Fengrun District, Tangshan City made a judgment on the case of Zhao Moubin's car accident, finding that the driver Huang Shufen bears 70% of the compensation liability, and Zhao Moubin bears 30%, and judged that Huang Shufen should compensate Zhao Moubin for a total of more than 930,000 yuan. In addition to the compensation that Huang Shufen has paid, she still needs to pay about 860,000 yuan.

Huang Shufen did not appeal, but did not perform the compensation as scheduled.

On August 19, 2017, Zhao Yong applied to the court for enforcement.

  The case first became widely known five years ago.

Zhao Yong told reporters that it had been two years since the car accident happened, and his father became in a vegetative state after several operations, but Huang Shufen did not fulfill the compensation.

  Near the end of 2017, my father, who was in a vegetative state, was lying on the hospital bed. Complications such as cerebral herniation and thrombosis occurred frequently. The doctor said that the situation was not good and we had to plan for the worst.

  After the article was published, the "textbook-style Lao Lai" incident aroused social concern.

  On December 1, 2017, Zhao Yong's father passed away.

On the same day, the Tangshan Intermediate People's Court released information on the progress of the case, saying that after investigation, no real estate, vehicle registration information and deposits were found in Huang Shufen's name.

In view of Huang Shufen's failure to declare property as required and refusing to perform the effective judgment, the court included her on the list of dishonest persons subject to execution and restricted high consumption.

  On December 9, 2017, Huang Shufen was detained by Tangshan police on suspicion of causing a traffic accident.

On December 22 of the same year, with the approval of the Fengrun District Procuratorate of Tangshan City, Huang Shufen was arrested.

Since then, Huang Shufen was sentenced to 8 months in prison.

  A hearing after 1290 days

  After the "textbook-style Lao Lai" incident detonated public opinion, lawyer Yue Fenshan, a senior partner of Beijing Yuecheng Law Firm, contacted Zhao Yong to provide him with legal assistance.

  In 2018, after lawyers Zhao Yong and Yue Qishan obtained the execution file of the compensation case, they systematically analyzed Huang Shufen's running water information.

Combined with the enforcement ruling issued by the Fengrun District People's Court of Tangshan City, it was determined that the property under the name of Huang Shufen's daughter was jointly owned by Huang Shufen and her daughter.

  Zhao Yong submitted an indictment to the People's Court of Lunan District, Tangshan City, requesting the court to rule that Huang Shufen owns 70% of the property in her daughter's name.

The indictment pointed out that from January 1, 2016 to November 15, 2017, Huang Shufen would transfer money to her daughter almost every month on or a few days before the repayment of the mortgage.

  The case was lost in the first instance, and the court stated in its judgment that the signing of the house purchase contract and the registration of the real estate advance notice were all carried out in the name of Huang Shufen's daughter. According to the principle of legal property rights, Zhao Yong's claims were unreasonable.

Zhao Yong then appealed, and the Tangshan Intermediate People's Court upheld the original verdict in the second instance.

At the court hearing, Huang Shufen characterized the transfer of money to her daughter from January 2016 to the end of 2017 as a gift.

  After discussing with the attorney, Zhao Yong decided to sue again and asked Huang Shufen to revoke the gift transfer to his daughter.

Yue Fenshan said in an interview with the media, "These gifts occurred after the accident and the court's judgment. We believe that there is a suspicion of evading the court's execution and transferring property."

  On January 9, 2019, Zhao Yong submitted a complaint to the People's Court of Lunan District, Tangshan City.

  On July 27, 2021, Zhao Yong received a case filing notice.

On July 22 this year, 1,290 days after the filing of the complaint, the case officially opened for trial.

According to the newly obtained running water information, Zhao Yongfang advocated that Huang Shufen should revoke the donation of about 620,000 yuan to her daughter.

  Before the trial, Zhao Yong picked four books and put them on the table in the conference room, hoping to bring some good luck.

Three of them are related to law, namely "Civil Code of the People's Republic of China", "Criminal Trial Reference" and Luo Xiang's "Circle of Justice".

The big red Civil Code is placed at the top.

  As the attorney for Zhao Yong, lawyer Feng Shuo of Beijing Yuecheng Law Firm brought three paper bags full of litigation materials.

  Regarding the trial situation, Zhao Yong said that the details of the trial could not be disclosed before the sentencing.

  Huang Shufen's attorney, lawyer Liu Chuncheng of Beijing Huapeng Law Firm, concluded that Huang Shufen has a 90% chance of winning the case.

  At present, the People's Court of Lunan District, Tangshan City has not yet announced the verdict.
