The National Commission for Markets and Competition (CNMC) has sanctioned Radio Televisión Española and Atresmedia for covert advertising on Masterchef Celebrity and on the La Sexta channel, as reported by the institution.

Specifically, the CNMC has sanctioned

RTVE with 125,581 euros

for the broadcast of covert commercial communications during the broadcast of the

Masterchef Celebrity

program on October 25 and 30, 2021.

The CNMC has confirmed that at various points in the program on October 25 there were references to

food products that a former contestant

on the '

Masterchef

' program , Amelicious, sells online.

Among the references,

"the virtues of these products are described

and some of them are shown; all this linked to the content of the program".

The entity recalls that these broadcasts violate article 18.2 of the General Law of Audiovisual Communication, by presenting real products that exist in the market and that could have

a clear advertising purpose

on the part of the television provider and mislead the public as far as to its nature, without at any time during

the broadcast warning of its treatment as advertising

or any overprint appearing to identify it.

This program was repeated on October 30, 2021 on TVE 1.

RTVE sources have indicated to Europa Press that they will

appeal the sanction since a contentious-administrative appeal can be filed directly against this decision

before the National High Court within two months from the day following its notification.

On the other hand,

the CNMC has sanctioned Atresmedia with 185,585 euros

for violating article 18.2 of the General Audiovisual Communication Law (LGCA) by issuing covert advertising communications on the La Sexta channel.

Specifically, the agency indicates that this contrary practice occurred in

La Sexta Noticias 14 H

on December 5, 2021. "In that informative program, a commercial communication from the

Laguinda mobile application

was issued without identifying itself as such," it says.

The law establishes that

advertising placements "must be duly marked

so that the viewer always knows when they are receiving information and when they are trying to sell a commercial product."

The CNMC also recalls that, against this resolution,

Atresmedia may directly file a

contentious-administrative appeal before the National High Court within two months from the day following its notification.
