Three-quarters of opticians and audioprosthetists checked in 2021 "showed shortcomings" in the 100% health reform, according to a report from the Directorate General for Competition, Consumer Affairs and Fraud Prevention (DGCCRF) published on Thursday.

Only 6% of the culprits were the subject of official reports.

Non-compliant quotes, offers "disparaged" or even "not offered at all"... Access to fully reimbursed glasses and hearing aids, promised in 2017 by Emmanuel Macron, comes up against the ill will of some professionals.

In October 2020, the DGCCRF therefore launched an investigation, which "continued throughout 2021".

In total, more than 1,000 checks were carried out in 710 stores.

Result: 514 of them “presented at least one anomaly […] with shortcomings of varying severity”, sometimes having “the effect of diverting the consumer” or “limiting the information on the offer”.

Most of these breaches resulted in simple warnings or “compliance orders”.

Only 17 administrative reports were drawn up for the most serious breaches, as well as 15 criminal reports for “misleading commercial practices” or “lack of pre-contractual information”.

To maintain the pressure on the recalcitrant, the DGCCRF specifies that it "will renew its controls" in 2023.

For its part, Health Insurance carried out a “control action” at 192 opticians, in particular among those with the lowest sales rate in France for the 100% health offer.

Anomalies were also observed in a majority of stores.

But of the 107 at fault, only “34 financial penalty decisions have been taken” to date, for an average amount of 2,200 euros.
