We focused on some points related to the completion stage (acceptance or rejection) of residence permit applications.

In this article, we will begin to explain the different types of residence permits in Turkey;

Where we start with a short-term residence permit:

A short-term residence permit can only be granted to foreigners for the following reasons:

  • Conducting scientific research.

  • Owning real estate in Turkey.

  • Establishing business and trade relations.

  • Get in-service training.

  • Participation in educational exchange programs.

  • Residence in Turkey for the purpose of tourism.

  • Receive medical treatment.

  • Residence in Turkey due to decisions and assignments by judicial authorities and administrative authorities.

  • Attending Turkish language courses.

  • Participation in education, research, training and training programs through government institutions.

  • Stay in Turkey for another 6 months immediately after completing higher education (university).

  • To be a qualified investor.

  • Be a citizen of the Turkish Republic of Northern Cyprus.

All types of short-term residence permits can be renewed at the end of that period, except for those granted to foreigners who aim to stay in Turkey for another 6 months upon completion of their higher education;

Also, foreigners can only use this reason once

Only short-term residence permits of up to 5 years can be granted to TRNC citizens and qualified investors, here “Qualified Investor” means foreign investors who have made investments in Turkey that comply with the necessary criteria set by the Turkish Presidency through specific regulations.

All applicants based on reasons other than those listed above must apply for short-term residence permits, and permission is mostly granted for a maximum period of one year.

in general;

The authorities are fully empowered to decide on the duration of the short-term residence permits, the method of assessing the circumstances and the relevant documents submitted to them.

All types of short-term residence permits can be renewed at the end of that period, except for those granted to foreigners who aim to stay in Turkey for another 6 months upon completion of their higher education;

Also, foreigners can use this reason only once.

It should be noted that attending Turkish language courses can be used as a reason to apply for residence only twice.

Also, owning real estate in Turkey can be a valid reason to apply for a short-term residence permit only if the real estate in question is a residence, meaning that other types of real estate such as land cannot be used for the purpose of applying for a short-term residence permit.

Furthermore it;

The housing value should be at least $75,000 in municipal cities such as Istanbul, Bursa and Ankara, and $50,000 in other cities.

If there is joint ownership of the residence by several shareholders, all of these shareholders can apply for a short-term residence permit provided that they have a marriage relationship, otherwise, the joint ownership will deprive all owners of the right to apply for a short-term residence permit.

The establishment of business and trade relations can be used as a reason for submitting the application provided that a letter to attend or similar documents are submitted by the consignees or companies in Turkey during the application.

In practice;

In order for applicants to be able to apply for this type of short-term residence permit, they must enter Turkey with a Turkish visa for business and trade purposes or else they will not be eligible, this means that setting up a company in Turkey by itself is not enough to obtain this type of residence permit short term.

If the reason for applying is to participate in certain programs such as continuing education, educational exchange projects and scientific research;

Relevant documents providing the duration and details of this program must be submitted upon application, and short-term residence permits can only be issued within the limits of the length and duration of this program.

To be able to obtain short-term residence permits for tourism purposes, the travel plans as well as sufficient financial terms to cover the intended period of stay must be clearly stated to the authorities.

The authorities were very flexible about such requests and were not expecting very detailed tourist plans at all until recently.

However;

It does not expect a detailed travel plan document, which can or should be obtained by approved tourism agencies and added to the residence permit application file.

Even if the addition of such a detailed tourism plan is necessary for the time being;

This does not guarantee acceptance of the file.

Furthermore it;

Highly detailed and long-term hotel reservations or a notarized accommodation lease contract, must be submitted in the application to prove that accommodation in Turkey is in order.

Receiving medical treatment as a valid reason for applying for short-term residence permits is subject to important limitations: the applicant’s illness must be considered a threat to public health, and a letter of acceptance from a hospital in Turkey, whether it is a public or private hospital, must also be submitted during the application.

Foreign journalists who have been exempted from the standard rules for work permits in Turkey can obtain short-term residence permits by presenting only their press cards, which are granted by the Turkish authorities, and their residence permits cannot be valid beyond the term of their press cards.

Attendance of Turkish language courses can be considered as a reason for requesting a short-term residence permit, only if the courses the applicants attend are accredited by the Ministry of National Education in Turkey, of which the Tömer program is the most popular.

Short-term residence permits obtained in this way cannot be valid after the term of the course programme.

Short-term residence permits are canceled or, at least, refused to renew if the reasons for which the applicants relied no longer exist or if the authorities discover that residence permits are not being used in accordance with their purposes, or if foreigners holding short-term residence permits are otherwise imposed on them. Forms, ban of entry or subject to a deportation decision.

According to the laws;

If holders of short-term residence permits stay outside Turkey for more than 120 days a year without any compelling reason related to public services, education, and health, then their short-term residence permits can be revoked.

However;

This rule is not practically applied at the moment.

However;

Turkish authorities can resume strict enforcement of this rule as soon as it has a ready legal basis.
