A court ruling is the first of its kind between a married couple in Morocco

In a precedent that is the first of its kind, the Family Court in the capital, Rabat, issued a judicial decision rejecting the husband’s request to compel the wife to have intercourse with him, as the matter has been rejected for a while.

The details of the decision, according to the "His Press" website, date back to March 9, after the court rejected the husband's request to force his wife into a legal relationship, on the grounds that cohabitation and what the "legitimate" duty of cohabitation requires is a duty and a right for both spouses.

In its ruling, the Commission considered that the goal of cohabitation within the institution of marriage is not only to satisfy instinctive desires, but rather the legislator has combined it with cohabitation etiquette that must be adhered to by the spouses, and must be followed only by consent and acceptance.

It is never imagined respecting these etiquettes whenever there is something that disturbs intimacy and undermines the partner’s attraction to his partner.

Samira Mohia, president of the Federation for Women's Rights, greeted the ruling with satisfaction as embodying the spirit of gender equality and an opportunity to support demands to amend the Family Code and remove points of inferiority and discrimination.

Mohia added, in a statement to "Hespress", that the decision links the moral rights of women to material ones as well, refusing to continue to devote the issue of obedience;

"Moroccan women have reached high levels, and they are also an independent entity."

The feminist human rights activist recorded that the ruling enshrines the principle of consent in the marital relationship and builds it on the basis of love and respect instead of coercion, warning that Moroccan legislation does not criminalize marital rape.

The President of the Federation of Women’s Rights League stressed the need to support the bodies with women judges, praising their presence in the current decision as they are familiar with matters that women only understand, with the importance of being open to the courts of appeal and cassation as well.
