In 2015, Shuji Tomohiro, a 41-year-old former sports instructor in Fuchu City, Tokyo, threw a 7-year-old twin brother, who was a dating woman at the time, into a planting on the street and injured him in 2016. Was charged with injuries and other charges for assaulting his eldest son's head in the park and injuring him with residual sequelae.



In the trial, it was disputed whether the defendant had assaulted his eldest son in the park. He was found not guilty of injuring his eldest son because of the possibility, and was sentenced to 1 year and 6 months in prison and a suspended sentence of 4 years.

In a ruling on the 21st, Masaaki Oka, the judge of the Supreme Court's First Small Court, said, "The eldest son was injured when he was receiving strict athletics guidance in the park from the defendant, and the defendant explained the lie at the hospital. In light of these circumstances, it is necessary to specifically consider whether the eldest son may have been injured by his own actions. "



After that, he revoked the judgment that he was partially acquitted and ordered the Tokyo High Court to redo the trial, saying that the two trials had not been sufficiently examined.
