Because it is eaten that breaks the fast after the end of the night, and the dawn prayer is obligatory, so whoever starts to pray the Sunnah prayer of dawn or the dawn itself upon hearing the muezzin, he has fulfilled the obligation of God Almighty, and that whoever eats or drinks at that time has transgressed the limits of God Almighty, and is violating the sanctity of fasting.

And this is what the scholars of the four imams have decided, as Imam al-Nawawi, may God have mercy on him, said in al-Majmoo’ 6/311: “If the dawn breaks and there is food in it, let him utter it and complete his fast.

Then he mentioned what some preachers might have mentioned regarding the inference for the permissibility of such an act, which is the hadith: “If one of you hears the call and the vessel is in his hand, he should not put it down until he has finished his need from it.” He replied with what Imam al-Bayhaqi decided in the major Sunan by saying: “And this, if it is authentic, is to be carried According to the common people of knowledge, he, may God’s prayers and peace be upon him, knew that the herald would call out before the break of dawn, so that his drinking occurred before the break of dawn.” The second call to prayer, and the saying of the Prophet, may God’s prayers and peace be upon him, “If one of you hears the call to prayer with the vessel in his hand,” a report on the first call, to be in agreement with the hadith of Ibn Omar and Aisha, may God be pleased with them.

This is how jurisprudential inference is for jurists and modernists, for they collect evidence in one chapter, take what is valid inference, and reject others, because the legal evidence ranks, the Qur’anic text is higher in authenticity than the Sunnah, and the correct Sunnah is not contradicted by a weak hadith, so how if the weak hadith It contradicts the text of the Qur’an and the authentic transmission and clear reasoning, for the Qur’an has permitted eating, drinking, and obscenity until the end of the night, and necessitated abstaining from that from the rise of the true dawn to sunset, and the mind does not accept that the time is night and day at the same time, for they are opposites that do not meet and do not rise, as well. About that the imams of jurisprudence have finished editing this issue, as was presented on the authority of Imam al-Nawawi, denying the difference in it, so it is necessary from all of that, and some of it is sufficient that people do not dare to pass on deviant fatwas and sayings to make people mistaken in the month of Ramadan, especially which is the fourth pillar of Islam, even if It was only piety and precaution in worship that would suffice, following the example of the Messenger of God, may God’s prayers and peace be upon him, his family and his companions.The one who was between his suhoor and his dawn prayer was as much as fifty verses, as in the two Sahihs from the hadith of Zaid bin Thabit, may God be pleased with him, and this is the period of abstinence that the scholars stipulated.
