Reader's help: I want to buy a new energy vehicle and I don't want it more than ten days after I signed it. Trouble is coming. Can I get the money back?

Mr. Wang, a reader in Hangzhou, asked the Hourly News reporter for help: I ordered a new energy vehicle last month and paid a deposit of 5,000 yuan. The sales said at the time that before the middle of the month, if I don’t want it, I can refund the deposit.

Later, I took a test drive and felt that this car was not particularly suitable for my family's situation.

Pay 5,000 yuan as a deposit to buy a car, but don't want it in the middle of the month

Mr. Wang placed the order on the evening of March 4, the price of the car was more than 270,000 yuan, and the deposit was 5,000 yuan.

"The salesman told me at the time that as long as he told him whether to sign a contract in the middle of the month, and if not, he could tell him, and the deposit could be credited to the account at any time."

Mr. Wang recalled that it was already after 10:00 pm on March 4th when the signing was completed. When the store closed, the whole process of payment and signing was indeed rushed.

A few days later, Mr. Wang went for a night test drive and saw other cars one after another.

After comparison, he felt that the car space was not large enough, so on the evening of March 15, he told the salesman that he did not want it through WeChat.

"I admit that the message was sent a little late, it was already 10 pm, but I responded to him in the middle of the month." Mr. Wang said, "He didn't reply me that night. The next morning, he replied that I replied too late. , the deposit will not be refunded."

"It was clearly stated that the order could be cancelled and the deposit returned before the middle of the month, but why not?" Mr. Wang contacted the brand's customer service center, and the official customer service's reply made him even more dumbfounded.

"The customer service said that the hesitation period for placing an order and paying the deposit is 72 hours. If it exceeds 72 hours, the deposit cannot be refunded." Mr. Wang said, this is a deviation from the sales statement, "If I knew there was a 72-hour hesitation period , I've already gone to refund the deposit."

On April 13, Mr. Wang negotiated with the sales again. The sales said it was true, and the deposit could not be refunded after the 72-hour hesitation period.

Lawyer reminder: Before signing and paying the deposit, the contract must be carefully read

The reporter then contacted the manager of the new energy vehicle center.

"We deal with it according to the contract. Before Mr. Wang places an order and pays the deposit, he needs to read the "General Terms of Subscription", which states the 72-hour hesitation period and relevant regulations." The store manager said, "And at that time What our sales told Mr. Wang is that the contract can be transferred in the middle of the month, not the deposit can be refunded in the middle of the month."

Mr. Wang admitted that when he placed the order and signed the order, he did not carefully read some regulations due to lack of time. It was his own mistake, but he clearly remembered that the sales said at that time that "you can return if you don't want it before the middle of the month", and now he only regrets it. It was not discreet enough at the time, and there was no recording.

The reporter noticed that there is another item in this "General Terms of Subscription Letter", that is, "If the car purchase agreement is not signed within 30 days after the deposit is paid, XX Auto has the right to cancel the subscription letter and not refund the deposit."

In other words, Mr. Wang's 5,000 yuan deposit cannot be returned.

In this regard, Mr. Wang expressed his dissatisfaction, and if necessary, he will take judicial measures to solve it.

The reporter consulted Chen Songtao, director of Zhejiang Fengguo Law Firm.

He wants to remind consumers: 1. The contract must be read carefully, signed, and you can't say that you don't know, this is also irresponsible to yourself.

2. Any promise of sales must be kept in evidence, preferably in writing; WeChat chat records and call recordings are also acceptable.
