 Turn to 'smart medicine' for inspiration

  "Post-80s" Zhao Songnan is a contract writer for a mainstream literary website.

According to the contract, junior writers can get 20 yuan per thousand words, and keep updating more than 5,000 words every day, and they can also get full attendance bonus every month.

Writing online novels has become Zhao Songnan's main source of income.

But after signing the contract, great creative pressure followed.

  Zhao Songnan made inquiries on the Internet and learned that there are channels for purchasing medicines abroad, so he found a seller in a foreign country on the online shopping platform.

The seller recommended a drug called armodafinil to Zhao Songnan, and told Zhao Songnan that armodafinil is a contraband in China and can only be mailed directly to China from abroad.

At this time, Zhao Songnan no longer cared about whether it was contraband, and wanted to eat this "panacea".

  In November 2019, Zhao Songnan placed an order for the first time and transferred 800 yuan through WeChat.

10 days later, a box of 50 tablets of Armodafinil crossed the ocean to the express cabinet in Zhao Songnan Community.

At the end of December 2019, Zhao Songnan placed an order with the seller again.

He thought it was as smooth as last time, but after half a month, he still hadn't received the courier.

In fact, the express delivery has been discovered by Nanjing Customs, and the clues were handed over to the anti-smuggling department. The investigators found Zhao Songnan based on the express information.

 There is a fine line between psychotropic drugs and drugs

  After arriving at the case, Zhao Songnan realized that buying illegal psychotropic drugs and taking them by himself is also a drug addiction, but it is too late to regret it now.

After being administratively detained by the local public security organ for 10 days, Zhao Songnan was placed on file for investigation by the Customs Sub-Bureau of smuggling drugs on suspicion of drug smuggling.

After that, the case was transferred to the Huai'an City People's Procuratorate for review and prosecution.

  According to Wang Yingjie, the undertaker of the case and the prosecutor of the Second Procuratorate of the Huai'an City Procuratorate, my country's "Criminal Law" clearly stipulates that smuggling, trafficking, transporting, and manufacturing drugs, regardless of the amount, should be investigated for criminal responsibility and punished.

  In this case, Zhao Songnan knew that Modafinil was a contraband in China, but still provided funds to allow others to mail it to China from abroad. There was both intentional smuggling and smuggling behavior, and he should also bear criminal responsibility for the crime of smuggling.

  Zhao Songnan knew the names and quantities of the smuggled items. It can be said that this smuggling act was ordered by him. Without his active pursuit, this crime would not have occurred.

Therefore, his behavior has far exceeded the scope of his own smoking, so he can not only bear the illegal responsibility of taking drugs, but also should bear the criminal responsibility of smuggling drugs.

  "However, Zhao Songnan is different from the drug criminals we have contacted in the past. In terms of personal danger, it is far lower than the former." Wang Yingjie communicated with the Anti-Smuggling Sub-Bureau when he intervened in advance, and suggested that he be released on bail pending trial.

In order to prevent him from being addicted, the procuratorial organ also suggested that the investigative organ conduct random inspections three times for supervision, and none of them found his relapse.

  In the second half of 2020, the Huai'an City People's Procuratorate prosecuted Zhao Songnan on suspicion of drug smuggling.

Because Zhao Songnan actively pleaded guilty and accepted punishment and the crime was minor, after a public hearing, the procuratorate suggested that he should be given a suspended sentence.

In the first half of 2021, the court sentenced Zhao Songnan to four months of detention, eight months of probation, and a fine of 3,000 yuan based on Zhao Songnan's criminal circumstances, confession attitude and past experience.
