The Force Ouvrière union on Tuesday denounced the working conditions of employees of ProBTP, a pension fund in the construction sector, in particular concerning breaks for going to the toilet.

Indeed, the FO ProBTP union deplores the decision of the general management of the company “to ask employees to clear for so-called physiological breaks”.

“Basically, our breaks, any type of break, whether for coffee, or a cigarette, or to chat with colleagues, we did not remove badges, we were paid,” explains Sébastien Guerre, FO union representative of this organization. which employs about 3,500 people.

A rule that obviously does not apply to sanitary breaks.

“Following our various interventions, the management granted that the employees have the right to ten minutes of break per day which will be paid”, specifies the union.

“If we badge ten minutes, or twice five minutes, the break will be paid, on the other hand, from the 11th minute, they will count the time beyond these ten minutes”, he added.

Management defends itself

The management confirmed that it had "reviewed the management of its employees' breaks in compliance with labor law".

“Although the joint agreements of the company never provided for the remuneration of these periods not worked, they were in practice all remunerated, according to a practice which had spread”, explained the management.

She decided “to get closer to the terms of the agreement by reducing paid breaks to 10 minutes a day.

Beyond this period, they are no longer considered as effective working time and are therefore no longer paid and no longer give rise to recovery leave, ”she said in a written response.

Beyond the questions of remuneration, "for all the employees of the group, the breaks are free, authorized without limitation of number or duration", defends the management of this group to the non-profit joint management.
