Dare to "enema and detox" in unqualified institutions, and replace invisible braces with steel hoops during the course of treatment

Why do young people always jump into the "pit" of medical beauty

The post-80s Xiaoqin (pseudonym) felt unwell after "enema and detoxification" at Shanghai Liangliang Beauty and Skin Care Center. After investigation, the institution was not qualified for medical services. The court ordered a refund of more than 660,000 yuan and tripled the compensation of more than 2 million yuan. Yuan; the post-90s Xiao Yang (pseudonym) straightened his teeth in a beauty clinic in Shanghai, and was "transferred" to another clinic a month later, but after wearing invisible braces for a year, he was told by the doctor that "you can no longer wear invisible braces." Now, the steel hoop has to be replaced."

The discussions on medical aesthetics at the National Two Sessions every year are always topics that resonate with the public, especially young women.

At this year's two sessions, Hu Wei, a member of the National Committee of the Chinese People's Political Consultative Conference and deputy director of the Science and Technology Education Committee of the Shanghai Municipal Committee of the Chinese People's Political Consultative Conference, suggested clarifying the business scope of the medical plastic surgery industry, and explicitly prohibited minors from carrying out plastic surgery projects other than necessary medical treatment such as face repair; Wang Xuekun, a member of the National Committee of the Chinese People's Political Consultative Conference and secretary of the Party Committee of the China Youth Research Center, commented on the frequently-appearing "Student Party's Appropriate Light Medical Beauty Experience", "Three Strategies to teach you how to convince your parents to undergo plastic surgery", "Medical beauty must be early, senior The truthful words of medical and aesthetic practitioners” and other content expressed concern.

In addition to the National People's Congress and the National People's Congress, reporters from China Youth Daily and China Youth Daily have also encountered many cases of being deceived in medical beauty. The young people of the session "repeatedly jumped".

Dare to "enema detox" in unqualified institutions

Xiaoqin is a girl who loves beauty and has strong spending power.

Since October 2015, she has spent more than 1.7 million yuan for beauty and skin care at Liangliang Beauty and Skin Care Center (hereinafter referred to as "Liangliang Beauty").

She has customized and purchased various beauty packages.

In 2017, she had been a VIP member of Liangliang Beauty for more than two years, and she got a "new news" - Liangliang Beauty launched "Drilling Liver", "Small Intestine Maintenance", "Pelvic Purification" and other health care programs, which have the effect of detoxification and beauty. Efficacy, combined with "pigment management" to remove wrinkles, freckle, and improve pigmentation, can achieve a significant effect of internal and external repair.

The beautician gave her "Amway" many items worth trying, among which, the "Enema Detoxification" program made Xiaoqin the most excited.

According to the original plan, after a whole course of "detoxification", Xiaoqin should become young and healthy from the inside out.

But the reality is that she gradually felt unwell during the treatment.

She reported her body condition to the beautician many times, but the other party explained that it was "the normal reaction of the body during the treatment".

Xiaoqin was skeptical and continued to do several project services, but her health deteriorated.

In March 2020, she complained to the district health and health committee where Liangliang Beauty was located.

According to the investigation by the Health and Health Commission, Liangliang Beauty has not obtained a medical institution license, but used enema and radio frequency medical technology methods in the process of providing enema detoxification, pigment management and other services for Xiaoqin. "Non-Health Technician".

To this end, the Health and Health Commission made an administrative penalty decision on Liangliang Beauty in accordance with laws and regulations.

Since then, Liangliang Beauty has been punished by the regional market supervision bureau for publishing content involving disease treatment functions and using medical terms in the store and WeChat public account publicity. It was ordered to stop publishing advertisements, eliminate the influence and impose a fine.

On March 2, the Shanghai No. 1 Intermediate People's Court conducted the second instance of Xiaoqin v. Liangliang Beauty Fraud, and sentenced her to refund the losses caused by the fraud to Xiaoqin, that is, the service fees paid for more than 660,000 yuan. , and in accordance with the relevant provisions of the Consumer Rights Protection Law, the compensation will be tripled, that is, more than 2 million yuan.

Invisible braces wear half of the course of treatment, to replace the steel hoop

A reporter from China Youth Daily and China Youth Daily noticed that Xiaoqin, who was supported by the court judge, was the "lucky one" among the many young people who had stepped on the "pit" of medical beauty. Overwhelmed and helpless.

Xiao Yang, a post-90s worker from Yunnan who came to Shanghai to work, is one of them.

Xiao Yang works as a beautician in a chain beauty agency in Shanghai. She heard that straightening teeth can make her face smaller, so she was recommended by a friend to go to a medical and beauty clinic in Minhang District, Shanghai to straighten her teeth.

At the doctor's recommendation, she used an invisible brace called "Angel of the Times" to straighten her teeth.

According to the original plan, her correction course should be about two years and cost 30,000 yuan.

But less than two months after she straightened her teeth in the medical beauty clinic, she was told that "the clinic has moved."

Immediately, she was transferred to another beauty clinic.

After receiving orthodontic services here for about 10 months, she was recently informed by the doctor that due to the current orthodontic condition of her teeth, it is no longer suitable to use invisible braces for orthodontic treatment and must be replaced with steel braces.

However, the price of steel hoops is only about one-third of invisible braces, and it affects the appearance.

Xiao Yang has repeatedly negotiated with the agency to no avail.

First, the cost of invisible braces has been paid and cannot be returned; secondly, steel braces have to be paid separately.

The reporter inquired about "Tianyancha" and found that the business scope of the two medical and aesthetic institutions that corrected Xiaoqin's teeth were "for-profit medical institutions".

The practice license of one of the medical institutions was obtained on June 7, 2021, while Xiao Yang went to the institution to see the dental clinic in March 2021.

Xiao Yang told reporters that at that time she was heading for a doctor who claimed to be from Shanghai Ninth People's Hospital.

But she only saw the doctor at the first consultation. After that, she changed several "doctors" passively for review and replacement of braces.

Everywhere is a "doctor of Shanghai Ninth Hospital", how to break it

The reporter noticed that "doctors from Shanghai No. 9 Hospital" have become the "signboard" of many medical and aesthetic institutions.

Shanghai Ninth Hospital is a non-profit, comprehensive tertiary-grade hospital.

In recent years, the medical beauty agency Lily has activated many "doctors from Shanghai No. 9 Hospital" and "retired doctors from Shanghai No. 9 Hospital", but the relevant person in charge of Shanghai No. 9 Hospital told reporters that many so-called "doctors from Shanghai No. 9 Hospital" are actually "non-genuine products." ".

For example, a biotech skincare founder "Wang Juan" with nearly 200,000 followers is active on a certain "planting grass" platform. She claims to have worked in the Shanghai Ninth Hospital's Rehabilitation Surgery for 30 years. Before retiring, she was the Shanghai Ninth Hospital Director of Plastic Surgery Laser Beauty Center.

However, after multiple verifications by reporters, there is no doctor named Wang Juan in the Shanghai No. 9 Hospital Rehabilitation Surgery Laser Beauty Center.

The relevant person in charge of Shanghai Ninth Hospital told reporters that in recent years, the name of "Shanghai Ninth Hospital" has been used indiscriminately on many social platforms, "Even if you add a V, you only upload the doctor's qualification certificate and do not need to be reviewed by the unit where he works. Agreed." The person in charge introduced that "doctors from Shanghai Ninth Hospital" can find their real names, identities, and majors on the official website of Shanghai Ninth Hospital, and don't "listen to the wind is rain in other institutions."

Judge Yang Sikong of the Shanghai No. 1 Intermediate People's Court has also tried many medical and cosmetic disputes in recent years. He believes that medical and cosmetic service disputes should be included in the adjustment scope of the Consumer Rights Protection Law, and the standard that operators constitute "fraud" should be established. , and earnestly safeguard the legitimate rights and interests of consumers.

"The medical beauty service industry is now an emerging industry that is popular among young people. However, in recent years, disputes have occurred frequently. The failure of medical beauty institutions to fulfill their obligation to inform or lack of corresponding medical qualifications has become the main cause of the conflict." Yang Sikong said that due to the professionalism of medical beauty There is a natural and obvious information asymmetry between medical institutions and consumers. "Consumers often lack the channels or awareness to identify the qualifications of beauty institutions. At this stage, it is necessary to apply the provisions of the Consumer Rights Protection Law to medical care. Beauty disputes, give consumers special protection."

He said that "unqualified services or false promises to consumers" is an important basis for determining that medical and aesthetic institutions constitute fraud.

Yang Sikong also noticed that some medical aesthetic disputes were caused by consumers who were dissatisfied with the medical aesthetic effect and failed to meet their psychological expectations.

He reminded consumers to realize that the effect of medical cosmetology is not only related to factors such as the level of doctors and the quality of medical services, but also closely related to consumers' own constitution and postoperative care, which has certain risks.

"When choosing a beauty institution, the beauty institution should be required to show relevant medical qualification certificates, reasonably determine the diagnosis and treatment plan, moderate consumption, and protect their own safety." Yang Sikong said.
