  1 year and 4 months in prison for eating a Chinese sturgeon

  March 1 marks the first anniversary of the official implementation of the Yangtze River Protection Law.

Over the past year, courts in Jiangsu Province have comprehensively used criminal, civil and administrative means to protect the ecological environment of the main stream of the Yangtze River and important water systems in the Yangtze River Basin, and concluded 1,804 cases involving environmental resources in the Yangtze River Basin.

On the same day, the Higher People's Court of Jiangsu Province released eight typical cases of Yangtze River protection, covering many aspects such as harming precious wild animals, illegal fishing, illegal sand mining, and environmental pollution.

  Caught Chinese sturgeon and couldn't sell it for food, sentenced to one year and four months and fined 20,000 yuan

  In March 2021, Li Moumou and others caught a Chinese sturgeon in the process of illegally fishing eel fry and other aquatic products in the waters near the mouth of the Yangtze River.

Li Moumou identified the fish as a Chinese sturgeon but did not take any protective measures. After contacting the sale, Li Moumou divided the fish into several pieces and brought it back to his residence for cooking and eating.

After identification, the fish is Chinese sturgeon, which is about 5 to 6 years old and the overall value is about 190,000 to 370,000 yuan.

  The Rugao City People's Court held that Li Moumou violated regulations on the protection of aquatic resources and caused the death of a national first-class protected wild animal, Chinese sturgeon, and his behavior constituted the crime of endangering precious and endangered wild animals.

The court sentenced Li Moumou to one year and four months in prison and a fine of RMB 20,000.

  The Xuanwu District People's Court ordered the insurance company of Ji Moumou's company to pay more than 200,000 yuan in the first instance based on the proportion of environmental tort accidents that the two companies should bear.

After the first-instance judgment, the two insurance companies appealed, and the Nanjing Environmental and Resources Court upheld the original judgment in the second instance.
